55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the purchase of cement or cement products by certain
88 governmental entities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 382, Health and Safety
1111 Code, is amended by adding Section 382.116 to read as follows:
1212 Sec. 382.116. AUTHORITY OF GOVERNMENTAL AGENCIES WITH
1313 REGARD TO CEMENT PURCHASING. Notwithstanding any other law, a
1414 municipality under Section 252.043, Local Government Code, a county
1515 under Section 262.027, Local Government Code, a governmental agency
1616 under Section 271.907, Local Government Code, and a school district
1717 under Section 44.031, Education Code, may implement procurement
1818 policies with respect to the purchase of cement relating to the
1919 cement manufacturing processes and the air contaminant emissions
2020 associated with the manufacture of the cement.
2121 SECTION 2. Section 252.043, Local Government Code, is
2222 amended by adding Subsection (c-1) to read as follows:
2323 (c-1) In addition to the criteria listed in Subsections (a)
2424 and (b), when awarding a contract for the purchase of cement or for
2525 construction services requiring the purchase and use of cement or
2626 cement products, a municipality may also consider the impact of the
2727 cement's manufacture on air quality in the municipality, including
2828 by considering:
2929 (1) the manufacturing process used for the cement; and
3030 (2) the air contaminant emissions associated with the
3131 manufacture of the cement.
3232 SECTION 3. Section 262.027, Local Government Code, is
3333 amended by amending Subsection (a) and adding Subsection (e-1) to
3434 read as follows:
3535 (a) The officer in charge of opening the bids shall present
3636 them to the commissioners court in session. Except as provided by
3737 Subsections [Subsection] (e) and (e-1), the court shall:
3838 (1) award the contract to the responsible bidder who
3939 submits the lowest and best bid; or
4040 (2) reject all bids and publish a new notice.
4141 (e-1) When awarding a contract for the purchase of cement or
4242 for construction services requiring the purchase and use of cement
4343 or cement products, the commissioners court may consider the impact
4444 of the cement's manufacture on air quality in the county, including
4545 by considering:
4646 (1) the manufacturing process used for the cement; and
4747 (2) the air contaminant emissions associated with the
4848 manufacture of the cement.
4949 SECTION 4. Section 271.907, Local Government Code, is
5050 amended by amending Subsection (d) and adding Subsection (c-1) to
5151 read as follows:
5252 (c-1) In addition to the considerations under Subsection
5353 (c), a governmental entity procuring cement may give a preference
5454 to cement from a vendor based on:
5555 (1) the manufacturing process used for the vendor's
5656 cement; or
5757 (2) the air contaminant emissions associated with the
5858 manufacture of the vendor's cement.
5959 (d) The preferences authorized by this section [preference]
6060 may be given only if the cost to the governmental agency for the
6161 entire project for which the goods or services will be used would
6262 not exceed 105 percent of the cost of the entire project if goods or
6363 services provided by a vendor who does not meet the standards were
6464 used.
6565 SECTION 5. Section 44.031, Education Code, is amended by
6666 adding Subsection (b-2) to read as follows:
6767 (b-2) In addition to the criteria listed in Subsection (b),
6868 when awarding a contract for the purchase of cement or for
6969 construction services requiring the purchase and use of cement or
7070 cement products, a district may also consider the impact of the
7171 cement's manufacture on air quality in the municipality in which
7272 the district is located, including by considering:
7373 (1) the manufacturing process used for the cement; and
7474 (2) the air contaminant emissions associated with the
7575 manufacture of the cement.
7676 SECTION 6. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2009.
