| 8 | 8 | adjustment management authority. | |
| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 375.312, Local Government Code, is | |
| 11 | 11 | amended by adding Subsections (c) and (d) to read as follows: | |
| 12 | 12 | (c) The board serves in an advisory capacity to advise and | |
| 13 | 13 | assist, as applicable, the zoning commission, planning commission, | |
| 14 | 14 | or governing body of: | |
| 15 | 15 | (1) a municipality regarding a proposed municipal | |
| 16 | 16 | zoning or development plan affecting territory in the authority | |
| 17 | 17 | that has been annexed by the municipality; or | |
| 18 | 18 | (2) a county regarding a proposed county zoning or | |
| 19 | 19 | development plan affecting territory in the authority that is | |
| 20 | 20 | subject to regulation by the county. | |
| 21 | 21 | (d) The governing body of the municipality or county shall | |
| 22 | 22 | cooperate with the board and adopt procedural rules for the board to | |
| 23 | 23 | follow in carrying out the board's advisory duties under Subsection | |
| 24 | 24 | (c). | |
| 25 | 25 | SECTION 2. This Act takes effect immediately if it receives | |
| 26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
| 27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
| 28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
| 29 | 29 | Act takes effect September 1, 2009. |
