| 7 | 7 | | relating to an electronic diagnostic database for rural physicians. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 1001, Health and Safety Code, is amended |
|---|
| 10 | 10 | | by adding Subchapter E to read as follows: |
|---|
| 11 | 11 | | SUBCHAPTER E. ELECTRONIC DIAGNOSTIC DATABASE FOR RURAL PHYSICIANS |
|---|
| 12 | 12 | | Sec. 1001.101. CREATION OF DATABASE. (a) The department |
|---|
| 13 | 13 | | shall create an electronic database to assist physicians practicing |
|---|
| 14 | 14 | | in rural areas in diagnosing rare or unusual illnesses or |
|---|
| 15 | 15 | | conditions. |
|---|
| 16 | 16 | | (b) The executive commissioner, by rule, shall designate |
|---|
| 17 | 17 | | for inclusion in the database diseases that are a threat to public |
|---|
| 18 | 18 | | health. |
|---|
| 19 | 19 | | (c) The database must be searchable based on a patient's |
|---|
| 20 | 20 | | symptoms, test results, or medical history. |
|---|
| 21 | 21 | | Sec. 1001.102. IMPLEMENTATION. The department shall place |
|---|
| 22 | 22 | | the system in rural clinics and hospitals across the state. |
|---|
| 23 | 23 | | Sec. 1001.103. FUNDING. In implementing the database, the |
|---|
| 24 | 24 | | department may use any available revenue, including federal |
|---|
| 25 | 25 | | disaster preparedness grant funds, other federal funds, and |
|---|
| 26 | 26 | | legislative appropriations, and may solicit and accept gifts, |
|---|
| 27 | 27 | | grants, and donations from a public or private source for the |
|---|
| 28 | 28 | | purposes of this subchapter. |
|---|
| 29 | 29 | | SECTION 2. (a) The executive commissioner of the Health and |
|---|
| 30 | 30 | | Human Services Commission shall adopt the rules required by Section |
|---|
| 31 | 31 | | 1001.101, Health and Safety Code, as added by this Act, not later |
|---|
| 32 | 32 | | than December 1, 2009. |
|---|
| 33 | 33 | | (b) The Department of State Health Services shall create and |
|---|
| 34 | 34 | | implement the electronic diagnostic database for rural physicians |
|---|
| 35 | 35 | | required by Subchapter E, Chapter 1001, Health and Safety Code, as |
|---|
| 36 | 36 | | added by this Act, not later than September 1, 2010. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2009. |
