66 AN ACT
77 relating to an electronic diagnostic database for rural physicians.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 1001, Health and Safety Code, is amended
1010 by adding Subchapter E to read as follows:
1111 SUBCHAPTER E. ELECTRONIC DIAGNOSTIC DATABASE FOR RURAL PHYSICIANS
1212 Sec. 1001.101. CREATION OF DATABASE. (a) The department
1313 shall create an electronic database to assist physicians practicing
1414 in rural areas in diagnosing rare or unusual illnesses or
1515 conditions.
1616 (b) The executive commissioner, by rule, shall designate
1717 for inclusion in the database diseases that are a threat to public
1818 health.
1919 (c) The database must be searchable based on a patient's
2020 symptoms, test results, or medical history.
2121 Sec. 1001.102. IMPLEMENTATION. The department shall place
2222 the system in rural clinics and hospitals across the state.
2323 Sec. 1001.103. FUNDING. In implementing the database, the
2424 department may use any available revenue, including federal
2525 disaster preparedness grant funds, other federal funds, and
2626 legislative appropriations, and may solicit and accept gifts,
2727 grants, and donations from a public or private source for the
2828 purposes of this subchapter.
2929 SECTION 2. (a) The executive commissioner of the Health and
3030 Human Services Commission shall adopt the rules required by Section
3131 1001.101, Health and Safety Code, as added by this Act, not later
3232 than December 1, 2009.
3333 (b) The Department of State Health Services shall create and
3434 implement the electronic diagnostic database for rural physicians
3535 required by Subchapter E, Chapter 1001, Health and Safety Code, as
3636 added by this Act, not later than September 1, 2010.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2009.
