5	5	relating to the punishment for the offense of prohibited sexual
6	6	conduct.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 25.02(c), Penal Code, is amended to read
9	9	as follows:
10	10	(c) An offense under this section is a felony of the third
11	11	degree, unless the offense is committed under Subsection (a)(1)
12	12	[(a)(6)], in which event the offense is a felony of the second
13	13	degree.
14	14	SECTION 2. The change in law made by this Act applies only
15	15	to an offense committed on or after the effective date of this Act.
16	16	An offense committed before the effective date of this Act is
17	17	covered by the law in effect when the offense was committed, and the
18	18	former law is continued in effect for that purpose. For purposes of
19	19	this section, an offense was committed before the effective date of
20	20	this Act if any element of the offense was committed before that
21	21	date.
22	22	SECTION 3. This Act takes effect September 1, 2009.
