| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 87.0241, Election Code, is amended by | |
| 11 | 11 | amending Subsection (b) and adding Subsection (d) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (b) Except as provided by Subsection (d), the [The] board | |
| 14 | 14 | may not count early voting ballots until: | |
| 15 | 15 | (1) the polls open on election day; or | |
| 16 | 16 | (2) in an election conducted by an authority of a | |
| 17 | 17 | county with a population of 100,000 or more or conducted jointly | |
| 18 | 18 | with such a county, the end of the period for early voting by | |
| 19 | 19 | personal appearance. | |
| 20 | 20 | (d) An early voting ballot board may establish a process for | |
| 21 | 21 | removing data from voting machines used in early voting before the | |
| 22 | 22 | polls open on election day if: | |
| 23 | 23 | (1) the county will use the voting machines on | |
| 24 | 24 | election day; and | |
| 25 | 25 | (2) the secretary of state approves the process. | |
| 26 | 26 | SECTION 2. This Act takes effect September 1, 2009. |
