9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter H, Chapter 1001, Education Code, is |
---|
11 | 11 | | amended by adding Section 1001.3541 to read as follows: |
---|
12 | 12 | | Sec. 1001.3541. ALTERNATIVE METHOD OF INSTRUCTION FOR |
---|
13 | 13 | | DRIVER EDUCATION COURSE. (a) A driver education school may teach |
---|
14 | 14 | | all or part of the classroom portion of an approved driver education |
---|
15 | 15 | | course by an alternative method of instruction that does not |
---|
16 | 16 | | require students to be present in a classroom if the commissioner |
---|
17 | 17 | | approves the alternative method. |
---|
18 | 18 | | (b) The commissioner may approve the alternative method |
---|
19 | 19 | | only if: |
---|
20 | 20 | | (1) the alternative method includes testing and |
---|
21 | 21 | | security measures that the commissioner determines are at least as |
---|
22 | 22 | | secure as the measures available in the usual classroom setting; |
---|
23 | 23 | | and |
---|
24 | 24 | | (2) the course, with the use of the alternative |
---|
25 | 25 | | method, satisfies any other requirement applicable to a course in |
---|
26 | 26 | | which the classroom portion is taught to students in the usual |
---|
27 | 27 | | classroom setting. |
---|
28 | 28 | | SECTION 2. Section 1001.151, Education Code, is amended by |
---|
29 | 29 | | adding Subsection (m) to read as follows: |
---|
30 | 30 | | (m) The commissioner may establish a fee for an application |
---|
31 | 31 | | for approval to offer a driver education course by an alternative |
---|
32 | 32 | | method of instruction under Section 1001.3541 in an amount the |
---|
33 | 33 | | commissioner considers appropriate, not to exceed the amount |
---|
34 | 34 | | sufficient to cover the costs of considering the application. |
---|
35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
---|
36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
---|
37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
---|
39 | 39 | | Act takes effect September 1, 2009. |
