| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter D, Chapter 12, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 12.136 to read as follows: |
|---|
| 13 | 13 | | Sec. 12.136. ACCOUNTABILITY: CHARTER SCHOOLS OPERATED BY |
|---|
| 14 | 14 | | JUVENILE BOARD AND FOCUSED ON JUVENILE JUSTICE. (a) This section |
|---|
| 15 | 15 | | applies only to an open-enrollment charter school that is operated |
|---|
| 16 | 16 | | by a juvenile board and that focuses on juvenile justice or |
|---|
| 17 | 17 | | corrections. |
|---|
| 18 | 18 | | (b) Academically, the mission of an open-enrollment charter |
|---|
| 19 | 19 | | school to which this section applies as provided by Subsection (a) |
|---|
| 20 | 20 | | is to enable students to perform at or above grade level. For |
|---|
| 21 | 21 | | purposes of accountability under Chapter 39, a student enrolled in |
|---|
| 22 | 22 | | the school is reported as if the student were enrolled at the |
|---|
| 23 | 23 | | student's assigned campus in the student's regularly assigned |
|---|
| 24 | 24 | | education program, including a special education program. |
|---|
| 25 | 25 | | Annually, the school, with the agreement of the commissioner, shall |
|---|
| 26 | 26 | | develop and implement a system of accountability consistent with |
|---|
| 27 | 27 | | Chapter 39, where appropriate, to assure that students make |
|---|
| 28 | 28 | | academic progress toward grade level while attending the school. |
|---|
| 29 | 29 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 30 | 30 | | school year. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2009. |
