5	5	relating to the political activities of a person employed by a
6	6	county elections administrator.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 31.039, Election Code, is amended by
9	9	amending Subsection (f) and adding Subsection (g) to read as
10	10	follows:
11	11	(f) Except as provided by Subsection (g), a [A] person
12	12	employed on a full-time basis by the administrator's office is
13	13	subject to Section 31.035 in the same manner as the administrator.
14	14	[This subsection applies only to counties with a population of one
15	15	million or more that have an election administrator.]
16	16	(g) Section 31.035(b) does not apply to a person employed on
17	17	a full-time basis by the administrator's office in a county with a
18	18	population of one million or less that has an election
19	19	administrator.
20	20	SECTION 2. This Act takes effect September 1, 2009.
