| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter G, Chapter 39, Education Code, is |
|---|
| 12 | 12 | | amended by adding Section 39.140 to read as follows: |
|---|
| 13 | 13 | | Sec. 39.140. SANCTIONS BASED SOLELY ON ASSESSMENT |
|---|
| 14 | 14 | | INSTRUMENT RESULTS PROHIBITED. (a) Notwithstanding any other |
|---|
| 15 | 15 | | provision of this subchapter, but subject to Subsection (b), the |
|---|
| 16 | 16 | | commissioner may not take action under this subchapter against a |
|---|
| 17 | 17 | | school district or campus based solely on the performance of the |
|---|
| 18 | 18 | | district or campus on an academic excellence indicator described by |
|---|
| 19 | 19 | | Section 39.051(b)(1) or (8). |
|---|
| 20 | 20 | | (b) The commissioner may take action under: |
|---|
| 21 | 21 | | (1) Section 39.131(a)(1) or (2) based solely on the |
|---|
| 22 | 22 | | performance of a school district on an academic excellence |
|---|
| 23 | 23 | | indicator described by Section 39.051(b)(1) or (8); or |
|---|
| 24 | 24 | | (2) Section 39.132(1) or (2) based solely on the |
|---|
| 25 | 25 | | performance of a campus on an academic excellence indicator |
|---|
| 26 | 26 | | described by Section 39.051(b)(1) or (8). |
|---|
| 27 | 27 | | SECTION 2. Section 39.140, Education Code, as added by this |
|---|
| 28 | 28 | | Act, does not affect the authority of the commissioner of education |
|---|
| 29 | 29 | | to continue any action authorized under Subchapter G, Chapter 39, |
|---|
| 30 | 30 | | Education Code, that was initiated before the effective date of |
|---|
| 31 | 31 | | this Act. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
