| 7 | 7 | | relating to participation in the group benefits program by certain |

| 8 | 8 | | retired state employees and their dependents. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1551.102, Insurance Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (j) to read as follows: |
|---|
| 12 | 12 | | (j) Subject to Section 1551.323, an individual is eligible |
|---|
| 13 | 13 | | to participate in the group benefits program as provided by |
|---|
| 14 | 14 | | Subsection (a), regardless of whether the individual is eligible to |
|---|
| 15 | 15 | | receive an annuity, if the individual retires and has at least 10 |
|---|
| 16 | 16 | | years of eligible service credit. |
|---|
| 17 | 17 | | SECTION 2. Section 1551.323, Insurance Code, is amended to |
|---|
| 18 | 18 | | read as follows: |
|---|
| 19 | 19 | | Sec. 1551.323. COST OF CERTAIN ANNUITANTS. (a) An |
|---|
| 20 | 20 | | annuitant eligible to participate under Section 1551.102(i), |
|---|
| 21 | 21 | | 1551.102(j), 1551.111(e), or 1551.112(c) is, except as provided by |
|---|
| 22 | 22 | | this subsection, required to pay the total cost, as determined by |
|---|
| 23 | 23 | | the board, attributable to the participation of that individual and |
|---|
| 24 | 24 | | the dependents of that individual until the date the individual is |
|---|
| 25 | 25 | | 65 years of age. If the General Appropriations Act or other similar |
|---|
| 26 | 26 | | legislation addresses the payment of those costs, those costs shall |
|---|
| 27 | 27 | | be paid in the manner specified by that legislation. |
|---|
| 28 | 28 | | (b) This section applies only to an individual who is |
|---|
| 29 | 29 | | eligible to participate as an annuitant under Section 1551.102(i), |
|---|
| 30 | 30 | | 1551.102(j), 1551.111(e), or 1551.112(c) and who is not eligible to |
|---|
| 31 | 31 | | participate under another provision of Section 1551.102, 1551.111, |
|---|
| 32 | 32 | | or 1551.112. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2009. |
