8 | 8 | | retirement at general academic teaching institutions. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter H, Chapter 51, Education Code, is |
---|
11 | 11 | | amended by adding Section 51.4021 to read as follows: |
---|
12 | 12 | | Sec. 51.4021. STUDY AND REPORT OF PREDICTED FACULTY |
---|
13 | 13 | | RETIREMENT. (a) In this section, "general academic teaching |
---|
14 | 14 | | institution," "governing board," and "university system" have the |
---|
15 | 15 | | meanings assigned by Section 61.003. |
---|
16 | 16 | | (b) To address the predicted retirement of a growing portion |
---|
17 | 17 | | of university faculty in the coming years and the potential |
---|
18 | 18 | | problems associated with that retirement, each general academic |
---|
19 | 19 | | teaching institution shall conduct a study relating to faculty |
---|
20 | 20 | | member retirements that may occur through the end of the 2025 |
---|
21 | 21 | | academic year, including projections of the number and proportion |
---|
22 | 22 | | of faculty members expected to retire during that period, the first |
---|
23 | 23 | | academic year in which increasing retirements are expected to |
---|
24 | 24 | | result in faculty shortages, and methods that the institution could |
---|
25 | 25 | | reasonably implement to address those retirement issues through |
---|
26 | 26 | | recruitment of new faculty members or other means. The governing |
---|
27 | 27 | | board of an institution may appoint a committee to conduct the |
---|
28 | 28 | | study. A university system may carry out the requirements |
---|
29 | 29 | | prescribed by this subsection for the system's component |
---|
30 | 30 | | institutions or may direct one or more component institutions to |
---|
31 | 31 | | conduct the study for the system. |
---|
32 | 32 | | (c) Each general academic teaching institution or |
---|
33 | 33 | | university system, as applicable, shall prepare a report based on |
---|
34 | 34 | | the study required by Subsection (b). The institution or system |
---|
35 | 35 | | shall submit the report to the Texas Higher Education Coordinating |
---|
36 | 36 | | Board not later than August 1, 2010. The coordinating board shall |
---|
37 | 37 | | compile the reports submitted to the board under this subsection |
---|
38 | 38 | | and, not later than December 1, 2010, shall submit the compilation |
---|
39 | 39 | | to the governor, the lieutenant governor, the speaker of the house |
---|
40 | 40 | | of representatives, and the presiding officer of each legislative |
---|
41 | 41 | | standing committee or subcommittee with primary jurisdiction over |
---|
42 | 42 | | higher education. |
---|
43 | 43 | | (d) This section expires January 1, 2011. |
---|
44 | 44 | | SECTION 2. This Act takes effect immediately if it receives |
---|
45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 48 | | Act takes effect September 1, 2009. |
