77 relating to a study and report concerning predicted faculty
88 retirement at general academic teaching institutions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter H, Chapter 51, Education Code, is
1111 amended by adding Section 51.4021 to read as follows:
1212 Sec. 51.4021. STUDY AND REPORT OF PREDICTED FACULTY
1313 RETIREMENT. (a) In this section, "general academic teaching
1414 institution," "governing board," and "university system" have the
1515 meanings assigned by Section 61.003.
1616 (b) To address the predicted retirement of a growing portion
1717 of university faculty in the coming years and the potential
1818 problems associated with that retirement, each general academic
1919 teaching institution shall conduct a study relating to faculty
2020 member retirements that may occur through the end of the 2025
2121 academic year, including projections of the number and proportion
2222 of faculty members expected to retire during that period, the first
2323 academic year in which increasing retirements are expected to
2424 result in faculty shortages, and methods that the institution could
2525 reasonably implement to address those retirement issues through
2626 recruitment of new faculty members or other means. The governing
2727 board of an institution may appoint a committee to conduct the
2828 study. A university system may carry out the requirements
2929 prescribed by this subsection for the system's component
3030 institutions or may direct one or more component institutions to
3131 conduct the study for the system.
3232 (c) Each general academic teaching institution or
3333 university system, as applicable, shall prepare a report based on
3434 the study required by Subsection (b). The institution or system
3535 shall submit the report to the Texas Higher Education Coordinating
3636 Board not later than August 1, 2010. The coordinating board shall
3737 compile the reports submitted to the board under this subsection
3838 and, not later than December 1, 2010, shall submit the compilation
3939 to the governor, the lieutenant governor, the speaker of the house
4040 of representatives, and the presiding officer of each legislative
4141 standing committee or subcommittee with primary jurisdiction over
4242 higher education.
4343 (d) This section expires January 1, 2011.
4444 SECTION 2. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2009.
