88 relating to the registration and compulsory inspection of certain
99 street rods and custom vehicles.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 501, Transportation Code,
1212 is amended by adding Section 501.038 to read as follows:
1313 Sec. 501.038. CERTIFICATE OF TITLE FOR CUSTOM VEHICLE OR
1414 STREET ROD. (a) In this section, "custom vehicle" and "street rod"
1515 have the meanings assigned by Section 504.502.
1616 (b) Notwithstanding any other provision of this chapter, if
1717 the department issues a certificate of title for a custom vehicle or
1818 street rod, the model year of the vehicle must be listed on the
1919 certificate of title and must be the model year that the body of the
2020 vehicle resembles. The certificate of title must also include the
2121 word "replica."
2222 (c) The owner of the custom vehicle or street rod shall
2323 provide the department with documentation identifying the model
2424 year that the body of the vehicle resembles.
2525 SECTION 2. Section 504.502, Transportation Code, is amended
2626 by amending Subsections (a), (b), and (i) and adding Subsection
2727 (f-1) and (f-2) to read as follows:
2828 (a) The department shall issue specialty license plates for
2929 a passenger car, truck, motorcycle, or former military vehicle
3030 that:
3131 (1) is at least 25 years old, if the vehicle is a
3232 passenger car, truck, or motorcycle or is a street rod or custom
3333 vehicle;
3434 (2) is a collector's item;
3535 (3) is used exclusively for exhibitions, club
3636 activities, parades, and other functions of public interest and is
3737 not used for regular transportation; and
3838 (4) does not carry advertising.
3939 (b) The license plates must include the words "Antique
4040 Auto," "Antique Truck," "Antique Motorcycle," "Street Rod,"
4141 "Custom Vehicle," or "Military Vehicle," as appropriate.
4242 (f-1) Notwithstanding Chapter 547, a custom vehicle or
4343 street rod eligible to receive license plates under this section is
4444 not required to be equipped with a specific piece of equipment
4545 unless the specific piece of equipment was required by statute as a
4646 condition of sale during the year listed as the model year on the
4747 certificate of title.
4848 (f-2) Upon initial registration of a custom vehicle or
4949 street rod, the owner must provide proof, acceptable to the
5050 Department, that the custom vehicle or street rod passed a safety
5151 inspection that has been approved by the Department. The department
5252 shall create a safety inspection process for inspecting replica
5353 custom vehicles or street rods.
5454 (i) In this section:
5555 (1) "Custom vehicle" means a vehicle:
5656 (A) that is:
5757 (i) at least 25 years old and of a model
5858 year after 1948; or
5959 (ii) manufactured to resemble a vehicle
6060 that is at least 25 years old and of a model year after 1948; and
6161 (B) that:
6262 (i) has been altered from the
6363 manufacturer's original design; or
6464 (ii) has a body constructed from materials
6565 not original to the vehicle.
6666 (2) "Former[, "former] military vehicle" means a
6767 vehicle, including a trailer, regardless of the vehicle's size,
6868 weight, or year of manufacture, that:
6969 (A) [(1)] was manufactured for use in any
7070 country's military forces; and
7171 (B) [(2)] is maintained to represent its
7272 military design and markings accurately.
7373 (3) "Street rod" means a vehicle:
7474 (A) that was manufactured:
7575 (i) before 1949; or
7676 (ii) after 1948 to resemble a vehicle
7777 manufactured before 1949; and
7878 (B) that:
7979 (i) has been altered from the
8080 manufacturer's original design; or
8181 (ii) has a body constructed from materials
8282 not original to the vehicle.
8383 SECTION 3. Section 548.052, Transportation Code, is amended
8484 to read as follows:
8585 Sec. 548.052. VEHICLES NOT SUBJECT TO INSPECTION. This
8686 chapter does not apply to:
8787 (1) a trailer, semitrailer, pole trailer, or mobile
8888 home moving under or bearing a current factory-delivery license
8989 plate or current in-transit license plate;
9090 (2) a vehicle moving under or bearing a paper dealer
9191 in-transit tag, machinery license, disaster license, parade
9292 license, prorate tab, one-trip permit, antique license, custom
9393 vehicle license, street rod license, temporary 24-hour permit, or
9494 permit license;
9595 (3) a trailer, semitrailer, pole trailer, or mobile
9696 home having an actual gross weight or registered gross weight of
9797 4,500 pounds or less;
9898 (4) farm machinery, road-building equipment, a farm
9999 trailer, or a vehicle required to display a slow-moving-vehicle
100100 emblem under Section 547.703;
101101 (5) a former military vehicle, as defined by Section
102102 504.502(i) [502.275];
103103 (6) a vehicle qualified for a tax exemption under
104104 Section 152.092, Tax Code; or
105105 (7) a vehicle for which a certificate of title has been
106106 issued but that is not required to be registered.
107107 SECTION 4. Section 504.502, Transportation Code, as amended
108108 by this Act, applies only to a registration period beginning on or
109109 after the effective date of this Act.
110110 SECTION 5. This Act takes effect September 1, 2009.
