66 AN ACT
77 relating to lobbying by former members of the legislature; creating
88 an offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 572, Government Code, is
1111 amended by adding Section 572.062 to read as follows:
1212 Sec. 572.062. FORMER LEGISLATOR: LOBBYING RESTRICTED;
1313 CRIMINAL OFFENSE. (a) In this section, "administrative action,"
1414 "communicates directly with," "legislation," "member of the
1515 executive branch," and "member of the legislative branch" have the
1616 meanings assigned by Section 305.002.
1717 (b) Except as provided by Subsection (c), a former member of
1818 the legislature may not, before the second anniversary of the date
1919 the person ceases to be a member, engage in activities that require
2020 registration under Chapter 305.
2121 (c) Subsection (b) does not apply to a former member who:
2222 (1) communicates directly with a member of the
2323 legislative or executive branch only to influence legislation or
2424 administrative action on behalf of:
2525 (A) a private, nonprofit organization;
2626 (B) an individual;
2727 (C) a group of low-income individuals; or
2828 (D) a group of individuals with disabilities; and
2929 (2) does not receive compensation other than
3030 reimbursement for actual expenses for engaging in communication
3131 described by Subdivision (1).
3232 (d) A former member who violates this section commits an
3333 offense. An offense under this section is a Class A misdemeanor.
3434 SECTION 2. Section 572.062, Government Code, as added by
3535 this Act, applies only to a member of the legislature who was first
3636 sworn into the office of state representative or state senator on or
3737 after January 1, 2009.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2009.
