| 6 | 6 | | Transportation of money appropriated by the federal government for |

| 7 | 7 | | the construction and maintenance of rail facilities. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 91.004(c), Transportation Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (c) Subsection (b) does not apply to money appropriated or |
|---|
| 12 | 12 | | allocated: |
|---|
| 13 | 13 | | (1) to a transit authority described by Chapter 451, a |
|---|
| 14 | 14 | | transportation authority described by Chapter 452 or 460, or a |
|---|
| 15 | 15 | | transit department described by Chapter 453; or |
|---|
| 16 | 16 | | (2) for use by: |
|---|
| 17 | 17 | | (A) a port authority or navigation district |
|---|
| 18 | 18 | | created or operating under Section 52, Article III, or Section 59, |
|---|
| 19 | 19 | | Article XVI, Texas Constitution; or |
|---|
| 20 | 20 | | (B) a district created under: |
|---|
| 21 | 21 | | (i) Chapter 171; |
|---|
| 22 | 22 | | (ii) Chapter 623, Acts of the 67th |
|---|
| 23 | 23 | | Legislature, Regular Session, 1981 (Article 6550c, Vernon's Texas |
|---|
| 24 | 24 | | Civil Statutes); |
|---|
| 25 | 25 | | (iii) Article 6550c-1, Revised Statutes; or |
|---|
| 26 | 26 | | (iv) Article 6550c-3, Revised Statutes. |
|---|
| 27 | 27 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 28 | 28 | | 91.004(c), Transportation Code, applies only to money appropriated |
|---|
| 29 | 29 | | or allocated on or after the effective date of this Act. Money |
|---|
| 30 | 30 | | appropriated or allocated before the effective date of this Act is |
|---|
| 31 | 31 | | subject to the law in effect on that date, and that law is continued |
|---|
| 32 | 32 | | in effect for that purpose. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2009. |
