77 relating to regulation of residential tenancies by local
88 governments.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 7, Local Government Code, is
1111 amended by adding Chapter 247 to read as follows:
1212 CHAPTER 247. CERTAIN PROHIBITIONS APPLYING TO MORE THAN ONE TYPE OF
1313 LOCAL GOVERNMENT
1414 Sec. 247.001. PROHIBITION AGAINST REGULATING RESIDENTIAL
1515 TENANCIES BASED ON IMMIGRATION STATUS. (a) A political
1616 subdivision may not require a landlord to:
1717 (1) refuse to lease to a prospective tenant or renew
1818 the lease of a tenant solely on the basis of the immigration status
1919 of the tenant or a member of the tenant's family; or
2020 (2) inquire as to the immigration status of a tenant or
2121 prospective tenant or a member of the tenant's family.
2222 (b) To the extent the prohibition imposed by Subsection (a)
2323 conflicts with common law, another state statute, or a local
2424 ordinance or other regulation, the prohibition in Subsection (a)
2525 prevails.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2009.
