9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subtitle C, Title 7, Local Government Code, is | |
11 | 11 | amended by adding Chapter 247 to read as follows: | |
12 | 12 | CHAPTER 247. CERTAIN PROHIBITIONS APPLYING TO MORE THAN ONE TYPE OF | |
13 | 13 | LOCAL GOVERNMENT | |
14 | 14 | Sec. 247.001. PROHIBITION AGAINST REGULATING RESIDENTIAL | |
15 | 15 | TENANCIES BASED ON IMMIGRATION STATUS. (a) A political | |
16 | 16 | subdivision may not require a landlord to: | |
17 | 17 | (1) refuse to lease to a prospective tenant or renew | |
18 | 18 | the lease of a tenant solely on the basis of the immigration status | |
19 | 19 | of the tenant or a member of the tenant's family; or | |
20 | 20 | (2) inquire as to the immigration status of a tenant or | |
21 | 21 | prospective tenant or a member of the tenant's family. | |
22 | 22 | (b) To the extent the prohibition imposed by Subsection (a) | |
23 | 23 | conflicts with common law, another state statute, or a local | |
24 | 24 | ordinance or other regulation, the prohibition in Subsection (a) | |
25 | 25 | prevails. | |
26 | 26 | SECTION 2. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2009. |
