| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 49.4645(a), Water Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) A district all or part of which is located in Bastrop |
|---|
| 14 | 14 | | County, Bexar County, Waller County, Hays County, Travis County, |
|---|
| 15 | 15 | | Williamson County, Harris County, Galveston County, Brazoria |
|---|
| 16 | 16 | | County, Montgomery County, or Fort Bend County may issue bonds |
|---|
| 17 | 17 | | supported by ad valorem taxes to pay for the development and |
|---|
| 18 | 18 | | maintenance of recreational facilities only if the bonds are |
|---|
| 19 | 19 | | authorized by a majority vote of the qualified voters of the |
|---|
| 20 | 20 | | district voting in an election held for that purpose. The |
|---|
| 21 | 21 | | outstanding principal amount of bonds, notes, and other obligations |
|---|
| 22 | 22 | | issued to finance parks and recreational facilities payable from |
|---|
| 23 | 23 | | any source may not exceed an amount equal to one percent of the |
|---|
| 24 | 24 | | value of the taxable property in the district as shown by the tax |
|---|
| 25 | 25 | | rolls of the central appraisal district at the time of the issuance |
|---|
| 26 | 26 | | of the bonds, notes, and other obligations or an amount greater than |
|---|
| 27 | 27 | | the estimated cost provided in the park plan under Subsection (b), |
|---|
| 28 | 28 | | whichever is smaller. The district may not issue bonds supported |
|---|
| 29 | 29 | | by ad valorem taxes to pay for the development and maintenance of: |
|---|
| 30 | 30 | | (1) indoor or outdoor swimming pools; or |
|---|
| 31 | 31 | | (2) golf courses. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect on the date on which the |
|---|
| 33 | 33 | | constitutional amendment proposed by the 81st Legislature, Regular |
|---|
| 34 | 34 | | Session, 2009, authorizing the legislature to permit conservation |
|---|
| 35 | 35 | | and reclamation districts in Hays County to issue bonds supported |
|---|
| 36 | 36 | | by ad valorem taxes takes effect. If that amendment is not approved |
|---|
| 37 | 37 | | by the voters, this Act has no effect. |
