77 relating to the authority of conservation and reclamation districts
88 in Hays County to issue bonds supported by ad valorem taxes to fund
99 the development and maintenance of recreational facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 49.4645(a), Water Code, is amended to
1212 read as follows:
1313 (a) A district all or part of which is located in Bastrop
1414 County, Bexar County, Waller County, Hays County, Travis County,
1515 Williamson County, Harris County, Galveston County, Brazoria
1616 County, Montgomery County, or Fort Bend County may issue bonds
1717 supported by ad valorem taxes to pay for the development and
1818 maintenance of recreational facilities only if the bonds are
1919 authorized by a majority vote of the qualified voters of the
2020 district voting in an election held for that purpose. The
2121 outstanding principal amount of bonds, notes, and other obligations
2222 issued to finance parks and recreational facilities payable from
2323 any source may not exceed an amount equal to one percent of the
2424 value of the taxable property in the district as shown by the tax
2525 rolls of the central appraisal district at the time of the issuance
2626 of the bonds, notes, and other obligations or an amount greater than
2727 the estimated cost provided in the park plan under Subsection (b),
2828 whichever is smaller. The district may not issue bonds supported
2929 by ad valorem taxes to pay for the development and maintenance of:
3030 (1) indoor or outdoor swimming pools; or
3131 (2) golf courses.
3232 SECTION 2. This Act takes effect on the date on which the
3333 constitutional amendment proposed by the 81st Legislature, Regular
3434 Session, 2009, authorizing the legislature to permit conservation
3535 and reclamation districts in Hays County to issue bonds supported
3636 by ad valorem taxes takes effect. If that amendment is not approved
3737 by the voters, this Act has no effect.
