66 AN ACT
77 relating to size limitations for certain physical education classes
88 in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 25.112(a) and (d), Education Code, are
1111 amended to read as follows:
1212 (a) Except as otherwise authorized by this section, a school
1313 district may not enroll more than 22 students in a kindergarten,
1414 first, second, third, or fourth grade class, including a physical
1515 education class. That limitation does not apply during:
1616 (1) any 12-week period of the school year selected by
1717 the district, in the case of a district whose average daily
1818 attendance is adjusted under Section 42.005(c); or
1919 (2) the last 12 weeks of any school year in the case of
2020 any other district.
2121 (d) On application of a school district, the commissioner
2222 may, for any class other than a physical education class, except the
2323 district from the limit in Subsection (a) if the commissioner finds
2424 the limit works an undue hardship on the district. An exception
2525 expires at the end of the semester for which it is granted, and the
2626 commissioner may not grant an exception for[:
2727 [(1)] more than one semester at a time.
2828 SECTION 2. This Act applies beginning with the 2009-2010
2929 school year.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2009.
