| 7 | 7 | | relating to size limitations for certain physical education classes |

| 8 | 8 | | in public schools. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 25.112(a) and (d), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) Except as otherwise authorized by this section, a school |
|---|
| 13 | 13 | | district may not enroll more than 22 students in a kindergarten, |
|---|
| 14 | 14 | | first, second, third, or fourth grade class, including a physical |
|---|
| 15 | 15 | | education class. That limitation does not apply during: |
|---|
| 16 | 16 | | (1) any 12-week period of the school year selected by |
|---|
| 17 | 17 | | the district, in the case of a district whose average daily |
|---|
| 18 | 18 | | attendance is adjusted under Section 42.005(c); or |
|---|
| 19 | 19 | | (2) the last 12 weeks of any school year in the case of |
|---|
| 20 | 20 | | any other district. |
|---|
| 21 | 21 | | (d) On application of a school district, the commissioner |
|---|
| 22 | 22 | | may, for any class other than a physical education class, except the |
|---|
| 23 | 23 | | district from the limit in Subsection (a) if the commissioner finds |
|---|
| 24 | 24 | | the limit works an undue hardship on the district. An exception |
|---|
| 25 | 25 | | expires at the end of the semester for which it is granted, and the |
|---|
| 26 | 26 | | commissioner may not grant an exception for[: |
|---|
| 27 | 27 | | [(1)] more than one semester at a time. |
|---|
| 28 | 28 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 29 | 29 | | school year. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
