55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to public access to the examination and approval of voting
88 systems used in an election.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 122.036, Election Code, is amended by
1111 amending Subsection (a) and adding Subsection (c) to read as
1212 follows:
1313 (a) The examiners shall examine the voting system or voting
1414 system equipment for which an application has been submitted at the
1515 time and in the manner directed by the secretary of state except
1616 that:
1717 (1) the examination must occur at an open meeting
1818 subject to Chapter 551, Government Code; and
1919 (2) an audiovisual recording of the examination must
2020 be created and made available to the public on request.
2121 (c) Subchapter B, Chapter 2001, Government Code, applies to
2222 all proposed certification examinations and decisions made as a
2323 result of those examinations by the secretary of state under this
2424 subchapter.
2525 SECTION 2. Section 122.068, Election Code, is amended to
2626 read as follows:
2727 Sec. 122.068. EXAMINATION AND REPORT BY EXAMINERS. (a) The
2828 examiners shall examine the modified system or equipment and
2929 prepare and deliver examination reports in the same manner as for an
3030 application for initial approval of a system or equipment.
3131 (b) Subchapter B, Chapter 2001, Government Code, applies to
3232 all proposed modification examinations and certification decisions
3333 made as a result of those examinations by the secretary of state
3434 under this subchapter.
3535 SECTION 3. Section 122.093, Election Code, is amended by
3636 amending Subsection (a) and adding Subsection (c) to read as
3737 follows:
3838 (a) The examiners shall examine the system or equipment to
3939 be reexamined at the time and in the manner directed by the
4040 secretary of state except that:
4141 (1) the reexamination must occur at an open meeting
4242 subject to Chapter 551, Government Code; and
4343 (2) an audiovisual recording of the reexamination must
4444 be created and made available to the public on request.
4545 (c) Subchapter B, Chapter 2001, Government Code, applies to
4646 all proposed reexaminations and certification decisions made as a
4747 result of those examinations by the secretary of state under this
4848 subchapter.
4949 SECTION 4. This Act takes effect September 1, 2009.
