| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter A, Chapter 43, Election Code, is | |
| 11 | 11 | amended by adding Section 43.008 to read as follows: | |
| 12 | 12 | Sec. 43.008. MAIN POLLING PLACE FOR CERTAIN VOTERS. (a) An | |
| 13 | 13 | authority conducting an election may establish on election day an | |
| 14 | 14 | additional polling place at the location of the main early voting | |
| 15 | 15 | polling place that is open during the first two hours of voting and | |
| 16 | 16 | during the last two hours of voting. | |
| 17 | 17 | (b) A voter may cast a ballot at the additional polling | |
| 18 | 18 | place established under this section if the voter executes an | |
| 19 | 19 | affidavit stating that the voter: | |
| 20 | 20 | (1) is unable to find the polling place in the voter's | |
| 21 | 21 | precinct; and | |
| 22 | 22 | (2) has not previously voted in the election. | |
| 23 | 23 | (c) The secretary of state shall adopt rules as necessary to | |
| 24 | 24 | implement this section. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2009. |
