55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to allowing certain early voting polling places to serve
88 as election day polling places.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 43, Election Code, is
1111 amended by adding Section 43.008 to read as follows:
1212 Sec. 43.008. MAIN POLLING PLACE FOR CERTAIN VOTERS. (a) An
1313 authority conducting an election may establish on election day an
1414 additional polling place at the location of the main early voting
1515 polling place that is open during the first two hours of voting and
1616 during the last two hours of voting.
1717 (b) A voter may cast a ballot at the additional polling
1818 place established under this section if the voter executes an
1919 affidavit stating that the voter:
2020 (1) is unable to find the polling place in the voter's
2121 precinct; and
2222 (2) has not previously voted in the election.
2323 (c) The secretary of state shall adopt rules as necessary to
2424 implement this section.
2525 SECTION 2. This Act takes effect September 1, 2009.
