55 relating to agreements with public junior colleges for courses for

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 130.008, Education Code, is amended by
99 adding Subsections (d) and (d-1) to read as follows:
1010 (d) Except as provided by Subsection (d-1), a public junior
1111 college may enter into an agreement with a school district,
1212 organization, or other person that operates a high school to offer a
1313 course as provided by this section regardless of whether the high
1414 school is located within the service area of the junior college
1515 district.
1616 (d-1) A public junior college may enter into an agreement
1717 described by Subsection (d) with respect to a high school located
1818 within the service area of another junior college district only if
1919 the other junior college district is unable to provide the
2020 requested course to the satisfaction of the school district.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2009.
