55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the display of emergency lighting on the personal
88 vehicle of a reserve peace officer.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 547.305, Transportation Code, is amended
1111 by amending Subsection (d) and adding Subsection (d-1) to read as
1212 follows:
1313 (d) A vehicle may be equipped with alternately flashing
1414 lighting equipment described by Section 547.701 or 547.702 only if
1515 the vehicle is:
1616 (1) a school bus;
1717 (2) an authorized emergency vehicle;
1818 (3) a personal vehicle of a reserve peace officer;
1919 (4) a church bus that has the words "church bus"
2020 printed on the front and rear of the bus so as to be clearly
2121 discernable to other vehicle operators;
2222 (5) [(4)] a tow truck while under the direction of a
2323 law enforcement officer at the scene of an accident or while hooking
2424 up to a disabled vehicle on a roadway; or
2525 (6) [(5)] a tow truck with a mounted light bar which
2626 has turn signals and stop lamps in addition to those required by
2727 Sections 547.322, 547.323, and 547.324[, Transportation Code].
2828 (d-1) A reserve peace officer whose vehicle is equipped with
2929 alternately flashing lighting equipment under Subsection (d) may
3030 use that lighting equipment only when the reserve peace officer is
3131 performing official duties as a reserve peace officer.
3232 SECTION 2. This Act takes effect September 1, 2009.
