7 | 7 | | relating to the display of emergency lighting on the personal |

8 | 8 | | vehicle of a reserve peace officer. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 547.305, Transportation Code, is amended |
---|
11 | 11 | | by amending Subsection (d) and adding Subsection (d-1) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (d) A vehicle may be equipped with alternately flashing |
---|
14 | 14 | | lighting equipment described by Section 547.701 or 547.702 only if |
---|
15 | 15 | | the vehicle is: |
---|
16 | 16 | | (1) a school bus; |
---|
17 | 17 | | (2) an authorized emergency vehicle; |
---|
18 | 18 | | (3) a personal vehicle of a reserve peace officer; |
---|
19 | 19 | | (4) a church bus that has the words "church bus" |
---|
20 | 20 | | printed on the front and rear of the bus so as to be clearly |
---|
21 | 21 | | discernable to other vehicle operators; |
---|
22 | 22 | | (5) [(4)] a tow truck while under the direction of a |
---|
23 | 23 | | law enforcement officer at the scene of an accident or while hooking |
---|
24 | 24 | | up to a disabled vehicle on a roadway; or |
---|
25 | 25 | | (6) [(5)] a tow truck with a mounted light bar which |
---|
26 | 26 | | has turn signals and stop lamps in addition to those required by |
---|
27 | 27 | | Sections 547.322, 547.323, and 547.324[, Transportation Code]. |
---|
28 | 28 | | (d-1) A reserve peace officer whose vehicle is equipped with |
---|
29 | 29 | | alternately flashing lighting equipment under Subsection (d) may |
---|
30 | 30 | | use that lighting equipment only when the reserve peace officer is |
---|
31 | 31 | | performing official duties as a reserve peace officer. |
---|
32 | 32 | | SECTION 2. This Act takes effect September 1, 2009. |
