55 AN ACT
66 relating to the posting of statements, registrations, and reports
77 filed with the Texas Ethics Commission on the commission's Internet
88 website.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. . Subchapter C, Chapter 571, Government Code, is
1111 amended by adding Section 571.0789 to read as follows:
1212 Sec. 571.0789. POSTING STATEMENTS, REGISTRATIONS, AND
1313 REPORTS ON WEBSITE. (a) This section applies to a statement,
1414 registration, or report filed with the commission under:
1515 (1) Chapter 302, 303, 305, 572, or 2004;
1616 (2) Subchapter C, Chapter 159, Local Government Code,
1717 by a county judicial officer, as defined by Section 159.051, Local
1818 Government Code, who elects to file a financial statement with the
1919 commission; or
2020 (3) Title 15, Election Code.
2121 (b) The commission shall post on its Internet website each
2222 statement, registration, or report filed with the commission not
2323 later than:
2424 (1) the 3rd business day after the date on which the
2525 statement, registration, or report is filed, if the statement,
2626 registration, or report is filed electronically; or
2727 (2) the 10th business day after the date on which the
2828 statement, registration, or report is filed, if the statement,
2929 registration, or report is not filed electronically.
3030 (c) Not later than November 1, 2009, the commission shall
3131 post on its website each personal financial statement filed with
3232 the commission for the 2000 calendar year or a later calendar year
3333 under:
3434 (1) Chapter 572; or
3535 (2) Subchapter C, Chapter 159, Local Government Code,
3636 by a county judicial officer who elects to file a financial
3737 statement with the commission.
3838 (d) Subsection (c) and this subsection expire January 1,
3939 2009.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2009.
