99 relating to the sheriff's department civil service commission
1010 appointments in certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 158.034, Local Government Code, is
1313 amended by amending Subsection (a) and adding Subsection (a-1) to
1414 read as follows:
1515 (a) In a county with a population of less than 2.8 million
1616 other than a county to which Subsection (a-1) applies, if a majority
1717 of the employees voting at the election approve the creation of a
1818 sheriff's department civil service system, the sheriff,
1919 commissioners court, and district attorney shall each appoint one
2020 person to serve as a member of the civil service commission that
2121 administers the system. In a county with a population of 2.8
2222 million or more, if a majority of the employees voting at the
2323 election approve the creation of a sheriff's department civil
2424 service system, the sheriff, commissioners court, and district
2525 attorney shall each appoint two persons to serve as members of the
2626 civil service commission that administers the system, and the three
2727 appointing authorities shall appoint one member by joint action
2828 requiring the affirmative vote of each of the authorities.
2929 (a-1) In a county with a population of one million or more in
3030 which more than 80 percent of the population resides in a single
3131 municipality, the employee organization representing the majority
3232 of sheriff department employees shall appoint two persons to serve
3333 as members of the civil service commission that administers the
3434 system in addition to the appointments by the sheriff,
3535 commissioners court, and district attorney.
3636 SECTION 2. This Act takes effect September 1, 2009.
