| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Sections 130.0012(a) and (b), Education Code, |
|---|
| 15 | 15 | | are amended to read as follows: |
|---|
| 16 | 16 | | (a) The Texas Higher Education Coordinating Board shall |
|---|
| 17 | 17 | | authorize a public junior college [colleges] to offer a |
|---|
| 18 | 18 | | baccalaureate degree program that qualifies under Subsection (e) |
|---|
| 19 | 19 | | if: |
|---|
| 20 | 20 | | (1) the program is [programs] in the field [fields] of |
|---|
| 21 | 21 | | applied science or [and] applied technology; or |
|---|
| 22 | 22 | | (2) the public junior college previously participated |
|---|
| 23 | 23 | | in a pilot project to offer baccalaureate degree programs [under |
|---|
| 24 | 24 | | this section. Offering a baccalaureate degree program under this |
|---|
| 25 | 25 | | section does not otherwise alter the role and mission of a public |
|---|
| 26 | 26 | | junior college]. |
|---|
| 27 | 27 | | (b) Offering a baccalaureate degree program under this |
|---|
| 28 | 28 | | section does not otherwise alter the role and mission of a public |
|---|
| 29 | 29 | | junior college. [The coordinating board shall authorize |
|---|
| 30 | 30 | | baccalaureate degree programs at each public junior college that |
|---|
| 31 | 31 | | previously participated in a pilot project to offer baccalaureate |
|---|
| 32 | 32 | | degree programs.] |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2009. |
