11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 170, Local Government Code, is amended | |
13 | 13 | by adding Section 170.002 to read as follows: | |
14 | 14 | Sec. 170.002. PURCHASE OF FIREARM BY HONORABLY RETIRED LAW | |
15 | 15 | ENFORCEMENT OFFICER. (a) An individual may purchase a firearm from | |
16 | 16 | a county if: | |
17 | 17 | (1) the individual was a peace officer commissioned by | |
18 | 18 | the county who is honorably retired; | |
19 | 19 | (2) the firearm had been previously issued to the | |
20 | 20 | individual by the county; and | |
21 | 21 | (3) the firearm is not a prohibited weapon under | |
22 | 22 | Section 46.05, Penal Code. | |
23 | 23 | (b) An individual may purchase only one firearm from a | |
24 | 24 | county under this section. | |
25 | 25 | (c) The county commissioners court shall establish the | |
26 | 26 | amount, which may not exceed fair market value, for which a firearm | |
27 | 27 | may be purchased under this section. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2009. |
