| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 801.256(b), Occupations Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) An applicant is eligible for a special license if: |
|---|
| 13 | 13 | | (1) the applicant: |
|---|
| 14 | 14 | | (A) is at least 21 years of age and a graduate of |
|---|
| 15 | 15 | | a board-approved veterinary medicine program at an institution of |
|---|
| 16 | 16 | | higher education; or |
|---|
| 17 | 17 | | (B) provides to the board a written affirmation |
|---|
| 18 | 18 | | by a person described under Subsection (f) that the applicant meets |
|---|
| 19 | 19 | | a critical need for staffing at the person's institution and is |
|---|
| 20 | 20 | | certified by a nationally recognized veterinary specialty board or |
|---|
| 21 | 21 | | is eligible for that certification; [and] or |
|---|
| 22 | 22 | | (C) is a graduate of an American Veterinary |
|---|
| 23 | 23 | | Medical Association-listed school or college of veterinary |
|---|
| 24 | 24 | | medicine and is employed in a post-Doctor of Veterinary Medicine |
|---|
| 25 | 25 | | training program at an American Veterinary Medical Association |
|---|
| 26 | 26 | | accredited school or college of veterinary medicine; and |
|---|
| 27 | 27 | | (2) the applicant passes the jurisprudence section of |
|---|
| 28 | 28 | | the licensing examination. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
