9 | 9 | | to the public health and safety or for emergency management |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 418, Government Code, is amended by |
---|
13 | 13 | | adding Subchapter I to read as follows: |

14 | 14 | | SUBCHAPTER I. CRITICAL SERVICE INFRASTRUCTURE INFORMATION FOR |
---|
15 | 15 | | ELECTRIC TRANSMISSION AND DISTRIBUTION EMERGENCY RESPONSE |
---|
16 | 16 | | Sec. 418.251. CRITICAL SERVICE INFRASTRUCTURE INFORMATION. |
---|
17 | 17 | | (a) To provide for rapid mitigation of disasters or emergencies |
---|
18 | 18 | | that result in widespread electric utility service outages, each |
---|
19 | 19 | | municipality and county shall provide the division with the |
---|
20 | 20 | | location of infrastructure in the municipality's or county's |
---|
21 | 21 | | jurisdiction that is critical to the public health or safety and |
---|
22 | 22 | | that requires electric utility service to adequately respond to or |
---|
23 | 23 | | to mitigate the effects of a disaster or emergency. |
---|
24 | 24 | | (b) A municipality or county shall file with the division |
---|
25 | 25 | | the critical infrastructure location information: |
---|
26 | 26 | | (1) annually; |
---|
27 | 27 | | (2) on a standardized form provided by the division to |
---|
28 | 28 | | be filed electronically or by mail; and |
---|
29 | 29 | | (3) by street address and by any other means of |
---|
30 | 30 | | identifying location the division requires. |
---|
31 | 31 | | (c) The division shall provide with the standardized form |
---|
32 | 32 | | information to assist a municipality or county in determining the |
---|
33 | 33 | | infrastructure in the municipality's or county's jurisdiction that |
---|
34 | 34 | | is critical to the public health or safety and that requires |
---|
35 | 35 | | electric utility service to adequately respond to or to mitigate |
---|
36 | 36 | | the effects of a disaster or emergency. The municipality or county |
---|
37 | 37 | | must rank the critical infrastructure identified on the form by |
---|
38 | 38 | | priority. The critical infrastructure identified must include: |
---|
39 | 39 | | (1) police and fire stations; |
---|
40 | 40 | | (2) relevant government buildings; |
---|
41 | 41 | | (3) sewage lift stations; |
---|
42 | 42 | | (4) water treatment facilities; and |
---|
43 | 43 | | (5) hospitals. |
---|
44 | 44 | | Sec. 418.252. DISTRIBUTION OF INFORMATION TO UTILITIES. |
---|
45 | 45 | | (a) The division shall provide to each electric utility that owns |
---|
46 | 46 | | electric transmission and distribution lines the critical |
---|
47 | 47 | | infrastructure location information for each municipality or |
---|
48 | 48 | | county served by the utility. The Public Utility Commission of |
---|
49 | 49 | | Texas shall assist the division in identifying the relevant |
---|
50 | 50 | | utilities and coordinating the delivery of the information. |
---|
51 | 51 | | (b) The division shall provide the information annually |
---|
52 | 52 | | under Subsection (a) not later than March 1. |
---|
53 | 53 | | Sec. 418.253. MAINTENANCE OF INFORMATION. (a) An electric |
---|
54 | 54 | | utility that receives the critical infrastructure location |
---|
55 | 55 | | information from the division shall: |
---|
56 | 56 | | (1) maintain the information to assist the utility |
---|
57 | 57 | | with efforts to restore electric utility service; and |
---|
58 | 58 | | (2) update the information annually with location |
---|
59 | 59 | | information as it is received from the division. |
---|
60 | 60 | | (b) The Public Utility Commission of Texas shall adopt rules |
---|
61 | 61 | | to ensure compliance with this section. |
---|
62 | 62 | | SECTION 2. This Act takes effect September 1, 2009. |
