1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 418, Government Code, is amended by
1313 adding Subchapter I to read as follows:
1414 SUBCHAPTER I. CRITICAL SERVICE INFRASTRUCTURE INFORMATION FOR
1515 ELECTRIC TRANSMISSION AND DISTRIBUTION EMERGENCY RESPONSE
1616 Sec. 418.251. CRITICAL SERVICE INFRASTRUCTURE INFORMATION.
1717 (a) To provide for rapid mitigation of disasters or emergencies
1818 that result in widespread electric utility service outages, each
1919 municipality and county shall provide the division with the
2020 location of infrastructure in the municipality's or county's
2121 jurisdiction that is critical to the public health or safety and
2222 that requires electric utility service to adequately respond to or
2323 to mitigate the effects of a disaster or emergency.
2424 (b) A municipality or county shall file with the division
2525 the critical infrastructure location information:
2626 (1) annually;
2727 (2) on a standardized form provided by the division to
2828 be filed electronically or by mail; and
2929 (3) by street address and by any other means of
3030 identifying location the division requires.
3131 (c) The division shall provide with the standardized form
3232 information to assist a municipality or county in determining the
3333 infrastructure in the municipality's or county's jurisdiction that
3434 is critical to the public health or safety and that requires
3535 electric utility service to adequately respond to or to mitigate
3636 the effects of a disaster or emergency. The municipality or county
3737 must rank the critical infrastructure identified on the form by
3838 priority. The critical infrastructure identified must include:
3939 (1) police and fire stations;
4040 (2) relevant government buildings;
4141 (3) sewage lift stations;
4242 (4) water treatment facilities; and
4343 (5) hospitals.
4444 Sec. 418.252. DISTRIBUTION OF INFORMATION TO UTILITIES.
4545 (a) The division shall provide to each electric utility that owns
4646 electric transmission and distribution lines the critical
4747 infrastructure location information for each municipality or
4848 county served by the utility. The Public Utility Commission of
4949 Texas shall assist the division in identifying the relevant
5050 utilities and coordinating the delivery of the information.
5151 (b) The division shall provide the information annually
5252 under Subsection (a) not later than March 1.
5353 Sec. 418.253. MAINTENANCE OF INFORMATION. (a) An electric
5454 utility that receives the critical infrastructure location
5555 information from the division shall:
5656 (1) maintain the information to assist the utility
5757 with efforts to restore electric utility service; and
5858 (2) update the information annually with location
5959 information as it is received from the division.
6060 (b) The Public Utility Commission of Texas shall adopt rules
6161 to ensure compliance with this section.
6262 SECTION 2. This Act takes effect September 1, 2009.
