10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Section 41.002, Health and Safety Code, is | |
12 | 12 | amended by adding Subsections (d) and (e) to read as follows: | |
13 | 13 | (d) Instead of providing financial assistance under | |
14 | 14 | Subsection (c), the department may assist an eligible person in | |
15 | 15 | obtaining insurance by providing premium payment assistance. In | |
16 | 16 | providing the premium payment assistance, the department may | |
17 | 17 | contract with a nonprofit entity that is exempt from federal | |
18 | 18 | taxation to make an insurance purchase on behalf of an eligible | |
19 | 19 | person. | |
20 | 20 | (e) For purposes of Section 1506.153, Insurance Code, a | |
21 | 21 | medically eligible person for whom a third party nonprofit entity | |
22 | 22 | makes an insurance purchase in accordance with a contract entered | |
23 | 23 | into under Subsection (d) is not, as a result of that purchase, an | |
24 | 24 | individual whose premiums are paid for or reimbursed under a | |
25 | 25 | government-sponsored program or by a government agency or health | |
26 | 26 | care provider. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2009. |
