55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to insurance premium payment assistance for certain
88 persons who have hemophilia and are unable to pay the entire cost of
99 treatment.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 41.002, Health and Safety Code, is
1212 amended by adding Subsections (d) and (e) to read as follows:
1313 (d) Instead of providing financial assistance under
1414 Subsection (c), the department may assist an eligible person in
1515 obtaining insurance by providing premium payment assistance. In
1616 providing the premium payment assistance, the department may
1717 contract with a nonprofit entity that is exempt from federal
1818 taxation to make an insurance purchase on behalf of an eligible
1919 person.
2020 (e) For purposes of Section 1506.153, Insurance Code, a
2121 medically eligible person for whom a third party nonprofit entity
2222 makes an insurance purchase in accordance with a contract entered
2323 into under Subsection (d) is not, as a result of that purchase, an
2424 individual whose premiums are paid for or reimbursed under a
2525 government-sponsored program or by a government agency or health
2626 care provider.
2727 SECTION 2. This Act takes effect September 1, 2009.
