77 relating to extension or modification of restrictive covenants in
88 certain residential real estate subdivisions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 210.001(4), Property Code, is amended to
1111 read as follows:
1212 (4) "Residential real estate subdivision" or
1313 "subdivision" has the meaning assigned by Section 201.003, except
1414 that the subdivision need not be located in a city, town, or village
1515 or within the extraterritorial jurisdiction of a city, town, or
1616 village.
1717 SECTION 2. Section 210.002, Property Code, is amended to
1818 read as follows:
1919 Sec. 210.002. APPLICABILITY OF CHAPTER. This chapter
2020 applies to a residential real estate subdivision that is located in
2121 a county with a population of:
2222 (1) more than 170,000 and less than 250,000 [175,000];
2323 or
2424 (2) more than 45,000 and less than 75,000 that is
2525 adjacent to a county with a population of more than 170,000 and less
2626 than 250,000 [175,000].
2727 SECTION 3. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
