9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 210.001(4), Property Code, is amended to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (4) "Residential real estate subdivision" or |
---|
13 | 13 | | "subdivision" has the meaning assigned by Section 201.003, except |
---|
14 | 14 | | that the subdivision need not be located in a city, town, or village |
---|
15 | 15 | | or within the extraterritorial jurisdiction of a city, town, or |
---|
16 | 16 | | village. |
---|
17 | 17 | | SECTION 2. Section 210.002, Property Code, is amended to |
---|
18 | 18 | | read as follows: |
---|
19 | 19 | | Sec. 210.002. APPLICABILITY OF CHAPTER. This chapter |
---|
20 | 20 | | applies to a residential real estate subdivision that is located in |
---|
21 | 21 | | a county with a population of: |
---|
22 | 22 | | (1) more than 170,000 and less than 250,000 [175,000]; |
---|
23 | 23 | | or |
---|
24 | 24 | | (2) more than 45,000 and less than 75,000 that is |
---|
25 | 25 | | adjacent to a county with a population of more than 170,000 and less |
---|
26 | 26 | | than 250,000 [175,000]. |
---|
27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
---|
28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
---|
29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
---|
31 | 31 | | Act takes effect September 1, 2009. |
