99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.056(b), Education Code, is amended to
1111 read as follows:
1212 (b) A [Except as provided by Subsection (e), a] declaration
1313 of write-in candidacy must be filed within the time prescribed by
1414 Section 144.006, Election Code [not later than 5 p.m. of the fifth
1515 day after the date an application for a place on the ballot is
1616 required to be filed].
1717 SECTION 2. Section 130.0825(b), Education Code, is amended
1818 to read as follows:
1919 (b) A [Except as provided by Subsection (e), a] declaration
2020 of write-in candidacy must be filed within the time prescribed by
2121 Section 144.006, Election Code [not later than 5 p.m. of the fifth
2222 day after the date an application for a place on the ballot is
2323 required to be filed].
2424 SECTION 3. Section 144.006, Election Code, is amended to
2525 read as follows:
2626 Sec. 144.006. FILING DEADLINE FOR DECLARED WRITE-IN
2727 CANDIDATE. (a) Except as otherwise provided by law, a declaration
2828 of write-in candidacy must be filed not later than 5 p.m. of the
2929 62nd day before election day [fifth day after the date an
3030 application for a place on the ballot is required to be filed] in an
3131 election in which[:
3232 [(1) the filing deadline for an application for a
3333 place on the ballot is the 62nd day before election day; and
3434 [(2)] write-in votes may be counted only for names
3535 appearing on a list of declared write-in candidates.
3636 (b) For an election to be held on the date of the general
3737 election for state and county officers, the day of the filing
3838 deadline is the 70th [67th] day before election day.
3939 SECTION 4. Section 146.054, Election Code, is amended to
4040 read as follows:
4141 Sec. 146.054. FILING DEADLINE. (a) Except as provided by
4242 Subsection (b), a declaration of write-in candidacy must be filed
4343 not later than 5 p.m. on the [of the fifth day after the] date an
4444 application for a place on the ballot is required to be filed.
4545 (b) For an election to be held on the date of the general
4646 election for state and county officers, the day of the filing
4747 deadline is the 70th [67th] day before election day.
4848 SECTION 5. Section 285.131(d), Health and Safety Code, is
4949 amended to read as follows:
5050 (d) A [Except as provided by Subsection (g), a] declaration
5151 of write-in candidacy must be filed within the time prescribed by
5252 Section 144.006, Election Code [not later than 5 p.m. of the fifth
5353 day after the date an application for a place on the ballot is
5454 required to be filed].
5555 SECTION 6. Section 50.004(d), Water Code, is amended to
5656 read as follows:
5757 (d) A declaration of write-in candidacy must be filed within
5858 the time prescribed by Section 144.006, Election Code [not later
5959 than 5 p.m. of the 45th day before election day]. However, if a
6060 candidate whose name is to appear on the ballot dies or is declared
6161 ineligible after the 65th [48th] day before election day, a
6262 declaration of write-in candidacy for the office sought by the
6363 deceased or ineligible candidate may be filed not later than 5 p.m.
6464 of the 59th [42nd] day before election day.
6565 SECTION 7. Section 63.0945(d), Water Code, is amended to
6666 read as follows:
6767 (d) A [Except as provided by Subsection (f), a] declaration
6868 of write-in candidacy must be filed within the time prescribed by
6969 Section 144.006, Election Code [not later than 5 p.m. of the fifth
7070 day after the date an application for a place on the ballot is
7171 required to be filed].
7272 SECTION 8. The following laws are repealed:
7373 (1) Sections 11.056(e) and 130.0825(e), Education
7474 Code;
7575 (2) Section 285.131(g), Health and Safety Code; and
7676 (3) Section 63.0945(f), Water Code.
7777 SECTION 9. The changes in law made by this Act apply only to
7878 an election ordered on or after the effective date of this Act.
7979 SECTION 10. This Act takes effect September 1, 2009.
