77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 302, Labor Code, is
99 amended by adding Section 302.016 to read as follows:
1010 Sec. 302.016. PEACE OFFICER EMPLOYMENT OPPORTUNITY
1111 INTERNET WEBSITE. (a) In this section, "peace officer" has the
1212 meaning assigned by Section 1701.001, Occupations Code.
1313 (b) The commission shall develop, maintain, and promote a
1414 statewide employment opportunity Internet website to facilitate:
1515 (1) public awareness of peace officer employment
1616 opportunities with state and local law enforcement agencies; and
1717 (2) an exchange of information between individuals
1818 seeking employment as peace officers in this state and state and
1919 local law enforcement agencies seeking applicants for employment as
2020 peace officers.
2121 (c) The Internet website must:
2222 (1) be accessible to members of the public; and
2323 (2) provide to individuals seeking employment as peace
2424 officers and state and local law enforcement agencies that have
2525 posted employment opportunities on the website an organized means
2626 of exchanging information.
2727 (d) The commission shall contract with the Commission on Law
2828 Enforcement Officer Standards and Education to develop a license
2929 verification interface to verify whether an applicant for
3030 employment as a peace officer:
3131 (1) holds a current license issued by the Commission
3232 on Law Enforcement Officer Standards and Education under Chapter
3333 1701, Occupations Code, and, if so, the level of that license; and
3434 (2) has had the applicant's license revoked or
3535 suspended by the Commission on Law Enforcement Officer Standards
3636 and Education.
3737 (e) The Commission on Law Enforcement Officer Standards and
3838 Education shall provide the commission with technical assistance in
3939 the development and testing of the license verification interface
4040 under Subsection (d).
4141 (f) If the development and operation of the Internet website
4242 and the associated license verification interface is not possible
4343 due to a lack of available funding, the commission shall:
4444 (1) enter into a memorandum of understanding with the
4545 Commission on Law Enforcement Officer Standards and Education to
4646 integrate a peace officer job matching database for individuals
4747 seeking employment as peace officers in this state and state and
4848 local law enforcement agencies seeking applicants for employment as
4949 peace officers into the commission's existing Labor Exchange
5050 System; and
5151 (2) ensure that:
5252 (A) the commission registers an Internet domain
5353 name that is unique and that identifies on its face the purpose of
5454 the peace officer job matching database; and
5555 (B) the registered domain name and associated
5656 link directs users of the Internet to a web page that instructs
5757 users on how to use the Labor Exchange System and includes a link to
5858 enter that system.
5959 SECTION 2. This Act does not make an appropriation. A
6060 provision in this Act that creates a new governmental program,
6161 creates a new entitlement, or imposes a new duty on a governmental
6262 entity is not mandatory during a fiscal period for which the
6363 legislature has not made a specific appropriation to implement the
6464 provision.
6565 SECTION 3. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect September 1, 2009.
