6 | 6 | | opportunity Internet website by the Texas Workforce Commission. |

7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

8 | 8 | | SECTION 1. Subchapter A, Chapter 302, Labor Code, is |
---|
9 | 9 | | amended by adding Section 302.016 to read as follows: |
---|
10 | 10 | | Sec. 302.016. PEACE OFFICER EMPLOYMENT OPPORTUNITY |
---|
11 | 11 | | INTERNET WEBSITE. (a) In this section, "peace officer" has the |
---|
12 | 12 | | meaning assigned by Section 1701.001, Occupations Code. |
---|
13 | 13 | | (b) The commission shall develop, maintain, and promote a |
---|
14 | 14 | | statewide employment opportunity Internet website to facilitate: |
---|
15 | 15 | | (1) public awareness of peace officer employment |
---|
16 | 16 | | opportunities with state and local law enforcement agencies; and |
---|
17 | 17 | | (2) an exchange of information between individuals |
---|
18 | 18 | | seeking employment as peace officers in this state and state and |
---|
19 | 19 | | local law enforcement agencies seeking applicants for employment as |
---|
20 | 20 | | peace officers. |
---|
21 | 21 | | (c) The Internet website must: |
---|
22 | 22 | | (1) be accessible to members of the public; and |
---|
23 | 23 | | (2) provide to individuals seeking employment as peace |
---|
24 | 24 | | officers and state and local law enforcement agencies that have |
---|
25 | 25 | | posted employment opportunities on the website an organized means |
---|
26 | 26 | | of exchanging information. |
---|
27 | 27 | | (d) The commission shall contract with the Commission on Law |
---|
28 | 28 | | Enforcement Officer Standards and Education to develop a license |
---|
29 | 29 | | verification interface to verify whether an applicant for |
---|
30 | 30 | | employment as a peace officer: |
---|
31 | 31 | | (1) holds a current license issued by the Commission |
---|
32 | 32 | | on Law Enforcement Officer Standards and Education under Chapter |
---|
33 | 33 | | 1701, Occupations Code, and, if so, the level of that license; and |
---|
34 | 34 | | (2) has had the applicant's license revoked or |
---|
35 | 35 | | suspended by the Commission on Law Enforcement Officer Standards |
---|
36 | 36 | | and Education. |
---|
37 | 37 | | (e) The Commission on Law Enforcement Officer Standards and |
---|
38 | 38 | | Education shall provide the commission with technical assistance in |
---|
39 | 39 | | the development and testing of the license verification interface |
---|
40 | 40 | | under Subsection (d). |
---|
41 | 41 | | (f) If the development and operation of the Internet website |
---|
42 | 42 | | and the associated license verification interface is not possible |
---|
43 | 43 | | due to a lack of available funding, the commission shall: |
---|
44 | 44 | | (1) enter into a memorandum of understanding with the |
---|
45 | 45 | | Commission on Law Enforcement Officer Standards and Education to |
---|
46 | 46 | | integrate a peace officer job matching database for individuals |
---|
47 | 47 | | seeking employment as peace officers in this state and state and |
---|
48 | 48 | | local law enforcement agencies seeking applicants for employment as |
---|
49 | 49 | | peace officers into the commission's existing Labor Exchange |
---|
50 | 50 | | System; and |
---|
51 | 51 | | (2) ensure that: |
---|
52 | 52 | | (A) the commission registers an Internet domain |
---|
53 | 53 | | name that is unique and that identifies on its face the purpose of |
---|
54 | 54 | | the peace officer job matching database; and |
---|
55 | 55 | | (B) the registered domain name and associated |
---|
56 | 56 | | link directs users of the Internet to a web page that instructs |
---|
57 | 57 | | users on how to use the Labor Exchange System and includes a link to |
---|
58 | 58 | | enter that system. |
---|
59 | 59 | | SECTION 2. This Act does not make an appropriation. A |
---|
60 | 60 | | provision in this Act that creates a new governmental program, |
---|
61 | 61 | | creates a new entitlement, or imposes a new duty on a governmental |
---|
62 | 62 | | entity is not mandatory during a fiscal period for which the |
---|
63 | 63 | | legislature has not made a specific appropriation to implement the |
---|
64 | 64 | | provision. |
---|
65 | 65 | | SECTION 3. This Act takes effect immediately if it receives |
---|
66 | 66 | | a vote of two-thirds of all the members elected to each house, as |
---|
67 | 67 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
68 | 68 | | Act does not receive the vote necessary for immediate effect, this |
---|
69 | 69 | | Act takes effect September 1, 2009. |
