| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 382.0205, Health and Safety Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | Sec. 382.0205. SPECIAL PROBLEMS RELATED TO AIR CONTAMINANT | |
| 13 | 13 | EMISSIONS. Consistent with applicable federal law, the commission | |
| 14 | 14 | by rule shall [may] control air contaminants as necessary to | |
| 15 | 15 | protect against adverse effects related to: | |
| 16 | 16 | (1) acid deposition; | |
| 17 | 17 | (2) stratospheric changes, including depletion of | |
| 18 | 18 | ozone; [and] | |
| 19 | 19 | (3) climatic changes, including global warming; and | |
| 20 | 20 | (4) the cumulative effects of multiple air | |
| 21 | 21 | contaminants on human health. | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2009. |
