7	7	relating to the hours for the wholesale delivery or sale of
8	8	alcoholic beverages.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 105.02(a), Alcoholic Beverage Code, is
11	11	amended to read as follows:
12	12	(a) Except as provided by Subsection (b) of this section, a
13	13	wholesaler or a local distributor's permittee may sell, offer for
14	14	sale, or deliver liquor to a retailer anytime [between 5 a. m. and 9
15	15	p. m. on any day] except Sunday and Christmas Day.
16	16	SECTION 2. Section 105.051, Alcoholic Beverage Code, is
17	17	amended to read as follows:
18	18	Sec. 105.051. SALE OF BEER BY DISTRIBUTOR'S LICENSEE.
19	19	The [In addition to the hours specified for the sale of beer in
20	20	Section 105.05(b) of this code, the] holder of a general, local, or
21	21	branch distributor's license may sell, offer for sale, or deliver
22	22	beer 24 hours a day Monday through Saturday and between midnight and
23	23	1 a.m. and between noon and midnight on [beginning at 5 a. m. on any
24	24	day except] Sunday.
25	25	SECTION 3. Section 105.052, Alcoholic Beverage Code, is
26	26	repealed.
27	27	SECTION 4. This Act takes effect immediately if it receives
28	28	a vote of two-thirds of all the members elected to each house, as
29	29	provided by Section 39, Article III, Texas Constitution. If this
30	30	Act does not receive the vote necessary for immediate effect, this
31	31	Act takes effect September 1, 2009.
