88 AN ACT
99 relating to fees imposed by local governments on the holders of
1010 certain alcoholic beverage permits.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.38, Alcoholic Beverage Code, is
1313 amended by amending Subsection (d) and adding Subsection (d-1) to
1414 read as follows:
1515 (d) The following are exempt from the fee authorized by
1616 Subsection (a) [in this section]:
1717 (1) agent's, airline beverage, passenger train
1818 beverage, industrial, carrier's, private carrier's, private club
1919 registration, local cartage, storage, and temporary wine and beer
2020 retailer's permits;
2121 (2) a wine and beer retailer's permit issued for a
2222 dining, buffet, or club car; and
2323 (3) a mixed beverage permit during the three-year
2424 period following the issuance of the permit.
2525 (d-1) In addition to any fees levied and collected under
2626 Subsection (a), the governing body of a city or town may levy and
2727 collect a fee of $750 for each mixed beverage permit issued for
2828 premises located within the city or town for each of the first three
2929 years following the issuance of the permit.
3030 SECTION 2. The change in law made by this Act applies only
3131 to an original or renewal mixed beverage permit for which an
3232 application is filed on or after the effective date of this Act. An
3333 original or renewal mixed beverage permit for which an application
3434 is filed before the effective date of this Act is governed by the
3535 law in effect immediately before the effective date of this Act, and
3636 that law is continued in effect for that purpose.
3737 SECTION 3. This Act takes effect September 1, 2009.
