| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 11.38, Alcoholic Beverage Code, is |
|---|
| 13 | 13 | | amended by amending Subsection (d) and adding Subsection (d-1) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (d) The following are exempt from the fee authorized by |
|---|
| 16 | 16 | | Subsection (a) [in this section]: |
|---|
| 17 | 17 | | (1) agent's, airline beverage, passenger train |
|---|
| 18 | 18 | | beverage, industrial, carrier's, private carrier's, private club |
|---|
| 19 | 19 | | registration, local cartage, storage, and temporary wine and beer |
|---|
| 20 | 20 | | retailer's permits; |
|---|
| 21 | 21 | | (2) a wine and beer retailer's permit issued for a |
|---|
| 22 | 22 | | dining, buffet, or club car; and |
|---|
| 23 | 23 | | (3) a mixed beverage permit during the three-year |
|---|
| 24 | 24 | | period following the issuance of the permit. |
|---|
| 25 | 25 | | (d-1) In addition to any fees levied and collected under |
|---|
| 26 | 26 | | Subsection (a), the governing body of a city or town may levy and |
|---|
| 27 | 27 | | collect a fee of $750 for each mixed beverage permit issued for |
|---|
| 28 | 28 | | premises located within the city or town for each of the first three |
|---|
| 29 | 29 | | years following the issuance of the permit. |
|---|
| 30 | 30 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to an original or renewal mixed beverage permit for which an |
|---|
| 32 | 32 | | application is filed on or after the effective date of this Act. An |
|---|
| 33 | 33 | | original or renewal mixed beverage permit for which an application |
|---|
| 34 | 34 | | is filed before the effective date of this Act is governed by the |
|---|
| 35 | 35 | | law in effect immediately before the effective date of this Act, and |
|---|
| 36 | 36 | | that law is continued in effect for that purpose. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2009. |
