66 AN ACT
77 relating to powers of the Port of Corpus Christi Authority of Nueces
88 County, Texas, pertaining to land in and adjacent to Naval Station
99 Ingleside.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 397, Acts of the 68th Legislature,
1212 Regular Session, 1983, is amended by amending Section 1 and adding
1313 Sections 1A and 4B to read as follows:
1414 Sec. 1. DEFINITIONS. In this Act:
1515 (1) "Adjacent property" means the approximately 433
1616 acres that the authority owns in San Patricio County that is bounded
1717 on the east by the western boundary of the Naval Station Ingleside,
1818 on the north by Farm-to-Market Road 1069, on the west by the city
1919 limits of the City of Ingleside on the Bay, and on the south by the
2020 city limits of the City of Ingleside on the Bay and the north
2121 shoreline of Corpus Christi Bay.
2222 (2) "Authority" means the Port of Corpus Christi
2323 Authority of Nueces County, Texas.
2424 (3) "Naval property" means:
2525 (A) the approximately 576.615 acres of land and
2626 submerged land in San Patricio and Nueces Counties, improvements,
2727 and personal property, if any, that revert to the authority when
2828 Naval Station Ingleside closes; and
2929 (B) the adjacent property.
3030 (4) "Port commission" means the governing body of the
3131 authority.
3232 Sec. 1A. COMPOSITION OF PORT COMMISSION. The port
3333 commission [of the Port of Corpus Christi Authority of Nueces
3434 County, Texas,] is composed of seven members.
3535 Sec. 4B. USE AND DISPOSITION OF NAVAL PROPERTY. (a) The
3636 authority may use the naval property in ways that replace and
3737 enhance the economic benefits generated by Naval Station Ingleside
3838 through diversified activities, including uses to foster:
3939 (1) the creation of new jobs;
4040 (2) economic development;
4141 (3) industry;
4242 (4) commerce;
4343 (5) manufacturing;
4444 (6) housing;
4545 (7) recreation; and
4646 (8) the installation of infrastructure on the naval
4747 property.
4848 (b) The authority may contract with another person for
4949 assistance in accomplishing the purposes of this section by
5050 competitive bidding or negotiated contract as the port commission
5151 considers appropriate, desirable, and in the best interests of the
5252 authority.
5353 (c) The port commission may declare any portion of the naval
5454 property not needed for a navigation-related project surplus
5555 property and may sell or lease the surplus property on terms the
5656 port commission considers advisable to carry out the purposes of
5757 this Act.
5858 (d) Notwithstanding any other law, and subject to the terms
5959 of this subsection, the authority may sell or lease surplus
6060 property with or without public bidding. Surplus property may not
6161 be sold for less than its fair market value. The authority shall
6262 obtain an appraisal of the surplus property, and the appraisal is
6363 conclusive evidence of the surplus property's fair market value.
6464 SECTION 2. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2009.
