7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Subsection 418.108(i), Government Code, is | |
9 | 9 | amended to read as follows: | |
10 | 10 | [(i)] A declaration under this section may include a | |
11 | 11 | restriction that exceeds a restriction authorized by Section | |
12 | 12 | 352.051, Local Government Code. [A restriction that exceeds a | |
13 | 13 | restriction authorized by Section 352.051, Local Government Code, | |
14 | 14 | is effective only: | |
15 | 15 | [(1) for 60 hours unless extended by the governor; and | |
16 | 16 | [(2) if the county judge requests the governor to | |
17 | 17 | grant an extension of the restrictions.] | |
18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
22 | 22 | Act takes effect September 1, 2009. |
