55 AN ACT
66 relating to a declaration of local disaster.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subsection 418.108(i), Government Code, is
99 amended to read as follows:
1010 [(i)] A declaration under this section may include a
1111 restriction that exceeds a restriction authorized by Section
1212 352.051, Local Government Code. [A restriction that exceeds a
1313 restriction authorized by Section 352.051, Local Government Code,
1414 is effective only:
1515 [(1) for 60 hours unless extended by the governor; and
1616 [(2) if the county judge requests the governor to
1717 grant an extension of the restrictions.]
1818 SECTION 2. This Act takes effect immediately if it receives
1919 a vote of two-thirds of all the members elected to each house, as
2020 provided by Section 39, Article III, Texas Constitution. If this
2121 Act does not receive the vote necessary for immediate effect, this
2222 Act takes effect September 1, 2009.
