| 7 | 7 | | relating to the filing of personal financial disclosure statements |

| 8 | 8 | | by municipal officers and candidates, members of the boards of |
|---|
| 9 | 9 | | trustees of school districts, and directors of sports and community |
|---|
| 10 | 10 | | venue districts. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 145.003, Local Government Code, is |
|---|
| 13 | 13 | | amended by amending Subsection (a) and adding Subsection (c) to |
|---|
| 14 | 14 | | read as follows: |
|---|
| 15 | 15 | | (a) Except as provided by Subsection (c), a [A] municipal |
|---|
| 16 | 16 | | officer or a candidate for a municipal office filled by election |
|---|
| 17 | 17 | | shall file a financial statement as required by this chapter. |
|---|
| 18 | 18 | | (c) A municipal officer who does not receive compensation |
|---|
| 19 | 19 | | for serving as an officer or a candidate for such an office is not |
|---|
| 20 | 20 | | required to file a financial statement under this chapter. |
|---|
| 21 | 21 | | SECTION 2. Section 11.064, Education Code, is repealed. |
|---|
| 22 | 22 | | SECTION 3. Section 335.1085, Local Government Code, is |
|---|
| 23 | 23 | | repealed. |
|---|
| 24 | 24 | | SECTION 4. (a) Section 145.003, Local Government Code, as |
|---|
| 25 | 25 | | amended by this Act, applies only to the filing by a municipal |
|---|
| 26 | 26 | | officer or employee of a financial statement that covers the 2009 or |
|---|
| 27 | 27 | | a later calendar year. The filing by a municipal officer or |
|---|
| 28 | 28 | | employee of a financial statement that covers the 2008 calendar |
|---|
| 29 | 29 | | year is governed by the law in effect on January 1, 2009, and the |
|---|
| 30 | 30 | | former law is continued in effect for that purpose. |
|---|
| 31 | 31 | | (b) The repeal by this Act of Section 11.064, Education |
|---|
| 32 | 32 | | Code, applies only to the filing by a school district trustee of a |
|---|
| 33 | 33 | | financial statement that covers the 2009 or a later calendar year. |
|---|
| 34 | 34 | | The filing by a school district trustee of a financial statement |
|---|
| 35 | 35 | | that covers the 2008 calendar year is governed by the law in effect |
|---|
| 36 | 36 | | on January 1, 2009, and the former law is continued in effect for |
|---|
| 37 | 37 | | that purpose. |
|---|
| 38 | 38 | | (c) The repeal by this Act of Section 335.1085, Local |
|---|
| 39 | 39 | | Government Code, applies only to the filing by a director of a venue |
|---|
| 40 | 40 | | district of a financial statement that covers the 2009 or a later |
|---|
| 41 | 41 | | calendar year. The filing by a director of a venue district of a |
|---|
| 42 | 42 | | financial statement that covers the 2008 calendar year is governed |
|---|
| 43 | 43 | | by the law in effect on January 1, 2009, and the former law is |
|---|
| 44 | 44 | | continued in effect for that purpose. |
|---|
| 45 | 45 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2009. |
