A BILL TO BE ENTITLED
AN ACT
relating to the date that an increase in the salary of a member of a
county commissioners court may take effect.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 152.013, Local Government Code, is
amended by adding Subsection (d) to read as follows:
(d) An increase in the salary of a member of the
commissioners court may not take effect until after the date of the
first primary election:
(1) at which the names of candidates for a party's
nomination for the member's office appear on the ballot; and
(2) that occurs after the date the increase is adopted
by the commissioners court.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
