| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 152.013, Local Government Code, is | |
| 11 | 11 | amended by adding Subsection (d) to read as follows: | |
| 12 | 12 | (d) An increase in the salary of a member of the | |
| 13 | 13 | commissioners court may not take effect until after the date of the | |
| 14 | 14 | first primary election: | |
| 15 | 15 | (1) at which the names of candidates for a party's | |
| 16 | 16 | nomination for the member's office appear on the ballot; and | |
| 17 | 17 | (2) that occurs after the date the increase is adopted | |
| 18 | 18 | by the commissioners court. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
