| 7 | 7 | | relating to the civil jurisdiction of a municipal court of record. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 30.00005(d), Government Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (d) The governing body of a municipality by ordinance may |
|---|
| 12 | 12 | | provide that the court has: |
|---|
| 13 | 13 | | (1) civil jurisdiction for the purpose of enforcing |
|---|
| 14 | 14 | | municipal ordinances enacted under Subchapter A, Chapter 214, Local |
|---|
| 15 | 15 | | Government Code, or Subchapter E, Chapter 683, Transportation Code; |
|---|
| 16 | 16 | | (2) concurrent jurisdiction with a district court or a |
|---|
| 17 | 17 | | county court at law under Subchapter B, Chapter 54, Local |
|---|
| 18 | 18 | | Government Code, within the municipality's territorial limits and |
|---|
| 19 | 19 | | property owned by the municipality located in the municipality's |
|---|
| 20 | 20 | | extraterritorial jurisdiction for the purpose of enforcing [health |
|---|
| 21 | 21 | | and safety and nuisance abatement] ordinances of the type listed in |
|---|
| 22 | 22 | | Section 54.012, Local Government Code; and |
|---|
| 23 | 23 | | (3) authority to issue: |
|---|
| 24 | 24 | | (A) search warrants for the purpose of |
|---|
| 25 | 25 | | investigating a health and safety or nuisance abatement ordinance |
|---|
| 26 | 26 | | violation; and |
|---|
| 27 | 27 | | (B) seizure warrants for the purpose of securing, |
|---|
| 28 | 28 | | removing, or demolishing the offending property and removing the |
|---|
| 29 | 29 | | debris from the premises. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2009. |
