55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the civil jurisdiction of a municipal court of record.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 30.00005(d), Government Code, is amended
1010 to read as follows:
1111 (d) The governing body of a municipality by ordinance may
1212 provide that the court has:
1313 (1) civil jurisdiction for the purpose of enforcing
1414 municipal ordinances enacted under Subchapter A, Chapter 214, Local
1515 Government Code, or Subchapter E, Chapter 683, Transportation Code;
1616 (2) concurrent jurisdiction with a district court or a
1717 county court at law under Subchapter B, Chapter 54, Local
1818 Government Code, within the municipality's territorial limits and
1919 property owned by the municipality located in the municipality's
2020 extraterritorial jurisdiction for the purpose of enforcing [health
2121 and safety and nuisance abatement] ordinances of the type listed in
2222 Section 54.012, Local Government Code; and
2323 (3) authority to issue:
2424 (A) search warrants for the purpose of
2525 investigating a health and safety or nuisance abatement ordinance
2626 violation; and
2727 (B) seizure warrants for the purpose of securing,
2828 removing, or demolishing the offending property and removing the
2929 debris from the premises.
3030 SECTION 2. This Act takes effect September 1, 2009.
