55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to taking into account the cost of fuel in establishing the
88 transportation allotment for school districts and counties
99 operating public school transportation systems.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 42.155, Education Code, is amended by
1212 amending Subsection (c) and adding Subsection (c-1) to read as
1313 follows:
1414 (c) Each district or county operating a regular
1515 transportation system is entitled to an allotment based on the
1616 daily cost per regular eligible student of operating and
1717 maintaining the regular transportation system and the linear
1818 density of that system. In determining the cost, [the commissioner
1919 shall give consideration to] factors affecting the actual cost of
2020 providing these transportation services in each district or county
2121 shall be taken into account including, as determined under
2222 Subsection (c-1), any increase in the price of gasoline, diesel, or
2323 other fuel needed for the transportation system. The average
2424 actual cost is to be computed by the commissioner [and included for
2525 consideration by the legislature in the General Appropriations
2626 Act]. The allotment per mile of approved route may not exceed the
2727 amount set by appropriation.
2828 (c-1) For purposes of Subsection (c), in establishing the
2929 allotment per mile of approved route, the cost of gasoline, diesel,
3030 and other fuels shall be biennially adjusted for any increases in
3131 the cost of those fuels as reflected in the Texas consumer price
3232 index, as published by the Bureau of Labor Statistics of the United
3333 States Department of Labor, as follows, whichever is greater:
3434 (1) the monthly average percentage increase in the
3535 cost of fuel during the 12-month period ending on December 31 of
3636 each even-numbered year; or
3737 (2) the highest three-month rolling average
3838 percentage increase during the 12-month period ending on December
3939 31 of each even-numbered year.
4040 SECTION 2. This Act takes effect September 1, 2009.
