7 | 7 | | relating to taking into account the cost of fuel in establishing the |

8 | 8 | | transportation allotment for school districts and counties |
---|
9 | 9 | | operating public school transportation systems. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 42.155, Education Code, is amended by |
---|
12 | 12 | | amending Subsection (c) and adding Subsection (c-1) to read as |
---|
13 | 13 | | follows: |
---|
14 | 14 | | (c) Each district or county operating a regular |
---|
15 | 15 | | transportation system is entitled to an allotment based on the |
---|
16 | 16 | | daily cost per regular eligible student of operating and |
---|
17 | 17 | | maintaining the regular transportation system and the linear |
---|
18 | 18 | | density of that system. In determining the cost, [the commissioner |
---|
19 | 19 | | shall give consideration to] factors affecting the actual cost of |
---|
20 | 20 | | providing these transportation services in each district or county |
---|
21 | 21 | | shall be taken into account including, as determined under |
---|
22 | 22 | | Subsection (c-1), any increase in the price of gasoline, diesel, or |
---|
23 | 23 | | other fuel needed for the transportation system. The average |
---|
24 | 24 | | actual cost is to be computed by the commissioner [and included for |
---|
25 | 25 | | consideration by the legislature in the General Appropriations |
---|
26 | 26 | | Act]. The allotment per mile of approved route may not exceed the |
---|
27 | 27 | | amount set by appropriation. |
---|
28 | 28 | | (c-1) For purposes of Subsection (c), in establishing the |
---|
29 | 29 | | allotment per mile of approved route, the cost of gasoline, diesel, |
---|
30 | 30 | | and other fuels shall be biennially adjusted for any increases in |
---|
31 | 31 | | the cost of those fuels as reflected in the Texas consumer price |
---|
32 | 32 | | index, as published by the Bureau of Labor Statistics of the United |
---|
33 | 33 | | States Department of Labor, as follows, whichever is greater: |
---|
34 | 34 | | (1) the monthly average percentage increase in the |
---|
35 | 35 | | cost of fuel during the 12-month period ending on December 31 of |
---|
36 | 36 | | each even-numbered year; or |
---|
37 | 37 | | (2) the highest three-month rolling average |
---|
38 | 38 | | percentage increase during the 12-month period ending on December |
---|
39 | 39 | | 31 of each even-numbered year. |
---|
40 | 40 | | SECTION 2. This Act takes effect September 1, 2009. |
