| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subtitle A, Title 7, Insurance Code, is amended |
|---|
| 10 | 10 | | by adding Chapter 1116 to read as follows: |
|---|
| 11 | 11 | | CHAPTER 1116. REQUIRED PROVISIONS FOR ANNUITY CONTRACT |
|---|
| 12 | 12 | | Sec. 1116.001. DEFINITION. In this chapter, "annuity" |
|---|
| 13 | 13 | | means a fixed, variable, or modified guaranteed annuity that is |
|---|
| 14 | 14 | | individually solicited, whether classified as an individual |
|---|
| 15 | 15 | | annuity or group annuity. |
|---|
| 16 | 16 | | Sec. 1116.002. RESCISSION PERIOD REQUIRED. An annuity |
|---|
| 17 | 17 | | contract must: |
|---|
| 18 | 18 | | (1) authorize the purchaser to rescind the contract |
|---|
| 19 | 19 | | and return it to the issuer without surrender fees for at least 30 |
|---|
| 20 | 20 | | days after the date the contract is entered into; and |
|---|
| 21 | 21 | | (2) provide for a refund to a purchaser who rescinds |
|---|
| 22 | 22 | | the contract during that period equal to the amount paid by the |
|---|
| 23 | 23 | | purchaser under the contract. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to an annuity contract delivered or issued for delivery on or after |
|---|
| 26 | 26 | | January 1, 2010. A contract delivered or issued for delivery before |
|---|
| 27 | 27 | | January 1, 2010, is governed by the law in effect immediately before |
|---|
| 28 | 28 | | the effective date of this Act, and that law is continued in effect |
|---|
| 29 | 29 | | for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
