77 relating to authorizing design-build procedures for construction,
88 rehabilitation, alteration, or repair of certain utility projects
99 located in certain areas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter J, Chapter 271, Local Government
1212 Code, is amended by adding Section 271.1821 to read as follows:
1313 Sec. 271.1821. APPLICABILITY TO CERTAIN PROJECTS IN CERTAIN
1414 AREAS. (a) This subchapter applies to a municipally owned combined
1515 electric, water, and wastewater utility located:
1616 (1) in an economically distressed area, as defined by
1717 Section 17.921, Water Code; and
1818 (2) within:
1919 (A) 30 miles of the Gulf of Mexico; and
2020 (B) 50 miles of an international border.
2121 (b) For purposes of this section, a utility is a combined
2222 utility if:
2323 (1) the governing body of the municipality appoints
2424 one board of directors that manages and controls the electric,
2525 water, and wastewater utilities; and
2626 (2) the financing of the capital improvements of the
2727 utilities described by Subdivision (1) is secured from the revenue
2828 of all three utilities described by Subdivision (1).
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
