| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter J, Chapter 271, Local Government |
|---|
| 12 | 12 | | Code, is amended by adding Section 271.1821 to read as follows: |
|---|
| 13 | 13 | | Sec. 271.1821. APPLICABILITY TO CERTAIN PROJECTS IN CERTAIN |
|---|
| 14 | 14 | | AREAS. (a) This subchapter applies to a municipally owned combined |
|---|
| 15 | 15 | | electric, water, and wastewater utility located: |
|---|
| 16 | 16 | | (1) in an economically distressed area, as defined by |
|---|
| 17 | 17 | | Section 17.921, Water Code; and |
|---|
| 18 | 18 | | (2) within: |
|---|
| 19 | 19 | | (A) 30 miles of the Gulf of Mexico; and |
|---|
| 20 | 20 | | (B) 50 miles of an international border. |
|---|
| 21 | 21 | | (b) For purposes of this section, a utility is a combined |
|---|
| 22 | 22 | | utility if: |
|---|
| 23 | 23 | | (1) the governing body of the municipality appoints |
|---|
| 24 | 24 | | one board of directors that manages and controls the electric, |
|---|
| 25 | 25 | | water, and wastewater utilities; and |
|---|
| 26 | 26 | | (2) the financing of the capital improvements of the |
|---|
| 27 | 27 | | utilities described by Subdivision (1) is secured from the revenue |
|---|
| 28 | 28 | | of all three utilities described by Subdivision (1). |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
