| 7 | 7 | | installation of address number signs to identify properties located |
|---|
| 8 | 8 | | in unincorporated areas of the county; providing a penalty. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 251.013, Transportation Code, is amended |
|---|
| 11 | 11 | | by adding Subsections (b-1) and (e) to read as follows: |
|---|
| 12 | 12 | | (b-1) The commissioners court of a county by order may: |
|---|
| 13 | 13 | | (1) adopt standards and specifications for the design |
|---|
| 14 | 14 | | and installation of address number signs to identify properties |
|---|
| 15 | 15 | | located in unincorporated areas of the county, including standards |
|---|
| 16 | 16 | | or specifications as to sign size, material, longevity, ability to |
|---|
| 17 | 17 | | be seen and to reflect light, and any other factor the commissioners |
|---|
| 18 | 18 | | court considers necessary or appropriate; and |
|---|
| 19 | 19 | | (2) require the owners or occupants of properties in |
|---|
| 20 | 20 | | unincorporated areas of the county to: |
|---|
| 21 | 21 | | (A) obtain address number signs that comply with |
|---|
| 22 | 22 | | the standards and specifications adopted under Subdivision (1); and |
|---|
| 23 | 23 | | (B) install and maintain those signs at the |
|---|
| 24 | 24 | | locations and in the manner required by those standards and |
|---|
| 25 | 25 | | specifications. |
|---|
| 26 | 26 | | (e) A person who knowingly fails or refuses to comply with |
|---|
| 27 | 27 | | an order of a commissioners court under Subsection (b-1)(2) commits |
|---|
| 28 | 28 | | an offense. An offense under this subsection is a Class C |
|---|
| 29 | 29 | | misdemeanor. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2009. |
