77 relating to funding for the fund for veterans' assistance.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter D, Chapter 502, Transportation Code,
1010 is amended by adding Section 502.1746 to read as follows:
1111 Sec. 502.1746. VOLUNTARY CONTRIBUTION TO VETERANS'
1212 ASSISTANCE FUND. (a) When a person registers a motor vehicle
1313 under this chapter, the person is entitled to make a voluntary
1414 contribution in any amount to the fund for veterans' assistance
1515 established by Section 434.017, Government Code, as amended by
1616 Chapter 1418 (H.B. 3107), Acts of the 80th Legislature, Regular
1717 Session, 2007.
1818 (b) The county assessor-collector shall send any
1919 contribution made under this section to the comptroller for deposit
2020 in the state treasury to the credit of the fund for veterans'
2121 assistance before the 31st day after the date the contribution is
2222 made.
2323 SECTION 2. Section 434.017, Government Code, as
2424 redesignated and amended by Chapter 1418 (H.B. 3107), Acts of the
2525 80th Legislature, Regular Session, 2007, is amended by amending
2626 Subsection (a) and adding Subsection (g) to read as follows:
2727 (a) The fund for veterans' assistance is a special fund in
2828 the state treasury outside the general revenue fund. The fund is
2929 composed of:
3030 (1) money transferred to the fund at the direction of
3131 the legislature;
3232 (2) money deposited to the credit of the fund under
3333 Section 502.1746, Transportation Code;
3434 (3) gifts, [and] grants, and donations contributed to
3535 the fund; and
3636 (4) [(3)] the earnings of the fund.
3737 (g) Notwithstanding other law, for purposes of Subchapter
3838 I, Chapter 659:
3939 (1) the fund is considered an eligible charitable
4040 organization entitled to participate in a state employee charitable
4141 campaign under Subchapter I, Chapter 659; and
4242 (2) a state employee is entitled to authorize a
4343 deduction for contributions to the fund as a charitable
4444 contribution under Section 659.132, and the Texas Veterans
4545 Commission may use the contributions for the purposes listed in
4646 Subsection (c).
4747 SECTION 3. This Act takes effect September 1, 2009.
