7 | 7 | | relating to elections affecting the boundaries of a public junior |
---|
8 | 8 | | college district. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 130.065(a), Education Code, is amended |
---|
11 | 11 | | to read as follows: |
---|
12 | 12 | | (a) On presentation to the governing board of a junior |
---|
13 | 13 | | college district of a petition proposing the annexation of |
---|
14 | 14 | | territory to the district, the governing board may call an election |
---|
15 | 15 | | on the question of annexing the territory. The petition must: |
---|
16 | 16 | | (1) contain an accurate description of the territory |
---|
17 | 17 | | proposed for annexation; and |
---|
18 | 18 | | (2) be signed by a number of registered voters in the |
---|
19 | 19 | | territory proposed to be annexed equal to at least three [five] |
---|
20 | 20 | | percent of the registered voters in that territory as of the most |
---|
21 | 21 | | recent general election for state and county officers. |
---|
22 | 22 | | SECTION 2. Sections 130.068(a) and (b), Education Code, are |
---|
23 | 23 | | amended to read as follows: |
---|
24 | 24 | | (a) The governing board of a junior college district may |
---|
25 | 25 | | order an election on the question of establishing expanded |
---|
26 | 26 | | boundaries for the junior college district to encompass all of the |
---|
27 | 27 | | territory located within the district's service area established by |
---|
28 | 28 | | Subchapter J, other than territory located in the service area of |
---|
29 | 29 | | another junior college district, if more than 25 [35] percent of the |
---|
30 | 30 | | total number of students who enrolled in the junior college |
---|
31 | 31 | | district in the most recent academic year resided outside of the |
---|
32 | 32 | | existing junior college district. |
---|
33 | 33 | | (b) The governing board of a junior college district may |
---|
34 | 34 | | order an election on the question of establishing expanded |
---|
35 | 35 | | boundaries for the junior college district to encompass part of the |
---|
36 | 36 | | territory located within the district's service area established by |
---|
37 | 37 | | Subchapter J, other than territory located in the service area of |
---|
38 | 38 | | another junior college district, if more than 10 [15] percent of the |
---|
39 | 39 | | high school graduates for each of the preceding five academic years |
---|
40 | 40 | | in the territory proposed to be added to the district have enrolled |
---|
41 | 41 | | in the junior college district. |
---|
42 | 42 | | SECTION 3. Section 130.065(a), Education Code, as amended |
---|
43 | 43 | | by this Act, applies only to a petition proposing annexation of |
---|
44 | 44 | | territory to a junior college district presented on or after the |
---|
45 | 45 | | effective date of this Act. A petition proposing annexation of |
---|
46 | 46 | | territory to a junior college district presented before the |
---|
47 | 47 | | effective date of this Act is covered by the law in effect on the |
---|
48 | 48 | | date the petition was presented, and that law is continued in effect |
---|
49 | 49 | | for that purpose. |
---|
50 | 50 | | SECTION 4. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2009. |
