55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to elections affecting the boundaries of a public junior
88 college district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 130.065(a), Education Code, is amended
1111 to read as follows:
1212 (a) On presentation to the governing board of a junior
1313 college district of a petition proposing the annexation of
1414 territory to the district, the governing board may call an election
1515 on the question of annexing the territory. The petition must:
1616 (1) contain an accurate description of the territory
1717 proposed for annexation; and
1818 (2) be signed by a number of registered voters in the
1919 territory proposed to be annexed equal to at least three [five]
2020 percent of the registered voters in that territory as of the most
2121 recent general election for state and county officers.
2222 SECTION 2. Sections 130.068(a) and (b), Education Code, are
2323 amended to read as follows:
2424 (a) The governing board of a junior college district may
2525 order an election on the question of establishing expanded
2626 boundaries for the junior college district to encompass all of the
2727 territory located within the district's service area established by
2828 Subchapter J, other than territory located in the service area of
2929 another junior college district, if more than 25 [35] percent of the
3030 total number of students who enrolled in the junior college
3131 district in the most recent academic year resided outside of the
3232 existing junior college district.
3333 (b) The governing board of a junior college district may
3434 order an election on the question of establishing expanded
3535 boundaries for the junior college district to encompass part of the
3636 territory located within the district's service area established by
3737 Subchapter J, other than territory located in the service area of
3838 another junior college district, if more than 10 [15] percent of the
3939 high school graduates for each of the preceding five academic years
4040 in the territory proposed to be added to the district have enrolled
4141 in the junior college district.
4242 SECTION 3. Section 130.065(a), Education Code, as amended
4343 by this Act, applies only to a petition proposing annexation of
4444 territory to a junior college district presented on or after the
4545 effective date of this Act. A petition proposing annexation of
4646 territory to a junior college district presented before the
4747 effective date of this Act is covered by the law in effect on the
4848 date the petition was presented, and that law is continued in effect
4949 for that purpose.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2009.
