44 AN ACT
55 relating to certain municipal requirements regarding sales of
66 residential properties in certain areas.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 214.905(d), Local Government Code, is
99 amended to read as follows:
1010 (d) This section does not apply to:
1111 (1) property that is part of an urban land bank
1212 program; or
1313 (2) a multifamily residential development of eight or
1414 more residential units:
1515 (A) intended for private sale;
1616 (B) located less than one mile from a commuter
1717 rail station; and
1818 (C) located in a municipality:
1919 (i) with a population of more than 650,000;
2020 (ii) that has a governing body consisting
2121 only of members who are elected at large; and
2222 (iii) in which a commuter rail system was
2323 approved by an election held after November 1, 2004.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2009.
