| 5 | 5 | | relating to certain municipal requirements regarding sales of |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 214.905(d), Local Government Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (d) This section does not apply to: |
|---|
| 11 | 11 | | (1) property that is part of an urban land bank |
|---|
| 12 | 12 | | program; or |
|---|
| 13 | 13 | | (2) a multifamily residential development of eight or |
|---|
| 14 | 14 | | more residential units: |
|---|
| 15 | 15 | | (A) intended for private sale; |
|---|
| 16 | 16 | | (B) located less than one mile from a commuter |
|---|
| 17 | 17 | | rail station; and |
|---|
| 18 | 18 | | (C) located in a municipality: |
|---|
| 19 | 19 | | (i) with a population of more than 650,000; |
|---|
| 20 | 20 | | (ii) that has a governing body consisting |
|---|
| 21 | 21 | | only of members who are elected at large; and |
|---|
| 22 | 22 | | (iii) in which a commuter rail system was |
|---|
| 23 | 23 | | approved by an election held after November 1, 2004. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2009. |
