| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 29.081, Education Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (d-1) to read as follows: |
|---|
| 10 | 10 | | (d-1) Notwithstanding Subsection (d)(1), a student is not |
|---|
| 11 | 11 | | considered a student at risk of dropping out of school if the |
|---|
| 12 | 12 | | student did not advance from prekindergarten or kindergarten to the |
|---|
| 13 | 13 | | next grade level only as the result of the request of the student's |
|---|
| 14 | 14 | | parent. |
|---|
| 15 | 15 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 16 | 16 | | school year. |
|---|
| 17 | 17 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 18 | 18 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 19 | 19 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 20 | 20 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 21 | 21 | | Act takes effect September 1, 2009. |
