| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 361, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 361.0882 to read as follows: |
|---|
| 12 | 12 | | Sec. 361.0882. TERM OF MUNICIPAL SOLID WASTE PERMIT. (a) A |
|---|
| 13 | 13 | | municipal solid waste permit issued under this chapter is valid for |
|---|
| 14 | 14 | | a term not to exceed 10 years. |
|---|
| 15 | 15 | | (b) The commission may renew a municipal solid waste permit |
|---|
| 16 | 16 | | in the manner provided by Section 361.088. |
|---|
| 17 | 17 | | SECTION 2. (a) Section 361.0882, Health and Safety Code, |
|---|
| 18 | 18 | | as added by this Act, applies to a municipal solid waste permit |
|---|
| 19 | 19 | | issued before, on, or after the effective date of this Act. |
|---|
| 20 | 20 | | (b) As soon as practicable after the effective date of this |
|---|
| 21 | 21 | | Act, the Texas Commission on Environmental Quality by rule shall |
|---|
| 22 | 22 | | adopt procedures and a schedule for the renewal of municipal solid |
|---|
| 23 | 23 | | waste permits issued before the effective date of this Act. |
|---|
| 24 | 24 | | (c) The schedule adopted by the Texas Commission on |
|---|
| 25 | 25 | | Environmental Quality for the renewal of municipal solid waste |
|---|
| 26 | 26 | | permits issued before the effective date of this Act may allow for |
|---|
| 27 | 27 | | Section 361.0882, Health and Safety Code, as added by this Act, to |
|---|
| 28 | 28 | | be implemented over any period of time the commission considers |
|---|
| 29 | 29 | | necessary for administrative feasibility and effectiveness. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
