55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to grants for school-based health centers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 38.063(a), (b), (d), (e), (f), and (g),
1010 Education Code, are amended to read as follows:
1111 (a) Subject to the availability of federal or state
1212 appropriated funds, the commissioner of state [public] health
1313 services shall administer a program under which grants are awarded
1414 to assist school districts and nonprofit organizations or
1515 governmental entities that collaborate with school districts with
1616 the costs of [operating] school-based health centers in accordance
1717 with this section.
1818 (b) The commissioner of state [public] health services, by
1919 rules adopted in accordance with this section, shall establish
2020 procedures for awarding grants. The rules must provide that:
2121 (1) grants are awarded annually [to school districts
2222 on an annual basis] through a competitive process to:
2323 (A) school districts; and
2424 (B) nonprofit organizations or governmental
2525 entities that collaborate with school districts to establish and
2626 operate school-based health centers; and
2727 (2) a preference is given to school-based health
2828 centers in school districts that are located in rural areas or that
2929 have low property wealth per student.
3030 (d) A school district, nonprofit organization, or
3131 governmental entity may not receive more than $250,000 per state
3232 fiscal biennium through grants awarded under this section.
3333 (e) To be eligible to receive a grant, a school district,
3434 nonprofit organization, or governmental entity must provide
3535 matching funds in accordance with rules adopted under Subsection
3636 (b). The matching funds may be obtained from any source available to
3737 the district, nonprofit organization, or governmental entity,
3838 including in-kind contributions, community or foundation grants,
3939 individual contributions, and local governmental agency operating
4040 funds.
4141 (f) The commissioner of state [public] health services
4242 shall adopt rules establishing standards for health care centers
4343 funded through grants that place primary emphasis on delivery of
4444 health services and secondary emphasis on population-based models
4545 that prevent emerging health threats.
4646 (g) The commissioner of state [public] health services
4747 shall require client surveys to be conducted in school-based health
4848 centers funded through grants awarded under this section, and the
4949 results of those surveys must be included in the annual report
5050 required under Section 38.064.
5151 SECTION 2. Section 38.064, Education Code, is amended to
5252 read as follows:
5353 Sec. 38.064. REPORT TO LEGISLATURE. (a) Based on
5454 statistics obtained from each [every] school-based health center
5555 that receives a grant under Section 38.063 [in this state], the
5656 commissioner of state [public] health services shall issue an
5757 annual report to the legislature about the relative efficacy of
5858 services delivered by school-based health centers that receive
5959 state grants and any increased academic success of students at
6060 campuses served by those centers, with special emphasis on any:
6161 (1) increased attendance;
6262 (2) [decreased drop-out rates;
6363 [(3)] improved student health; and
6464 (3) [(4)] improved performance on student assessment
6565 instruments administered under Subchapter B, Chapter 39.
6666 (b) In obtaining statistics for preparation of the report
6767 required by this section, the commissioner of state [public] health
6868 services shall ensure that data is collected [for each county] and
6969 aggregated appropriately according to geographical region.
7070 SECTION 3. This Act takes effect immediately if it receives
7171 a vote of two-thirds of all the members elected to each house, as
7272 provided by Section 39, Article III, Texas Constitution. If this
7373 Act does not receive the vote necessary for immediate effect, this
7474 Act takes effect September 1, 2009.
